Pursuant to due call and notice thereof, a reaylar - meeting of the City Council of the City of Plymouth, Minnesota, was held on the 18th day of �yust 19J,5 The following members were present: ils Seibold and S aeth. The o owing members were absent:— none ttic stir *** Councilman Hunt introduced the following Resolution and moved s a opt on: RESOLUTION NO. 75-420 A RESOLUTION DIRECTING THE PREPARATION OF ASSESSMENT ROLLS SUNNY ACRES THIRD ADDITION WHEREAS, the City Council did, on the 10th day of October, 1972 adopt Resolution No. 72-298A confirming and adopting the assessment for Kreatz Lake Storm Sewer Project No. 115, otherwise identified as Levy 5604 and, WHEREAS, following the adoption of such roll such levy was certified to the Hennepin County Auditor and, WHEREAS, thereafter a portion of the area so assessed was platted as Sunny Acres 3rd Addition, which plat consisted of 8 tots, numbered 1 through 8 and, Outlots A and B, and, WHEREAS, following the acceptance and filing of such plat, the total assessment levied against the property within such plat should have been proportionately divided amongst and spread upon each of the lots comprising such plat and, WHEREAS, an error was made in that the total assessment pertaining to such plat was levied upon and against Lot 1 and nothing was levied upon and against Lots 2 through 8 and, Outlots" A and B, WHEREAS, in order to correct such error, a supplemental assessment is necessary so that all lots in such plat received their proportionate share of such levy, NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, 1. Pursuant to the provisions of Section 429.071, Subdivisionl,Minnesota Statutes, it is hereby determined that a supplemental assessment of Levy 5604 is necessary in order to correct mistakes in such levy relating to the subdivision known as Sunny Acres 3rd Addition. 2. The City Clerk shall forthwith prepare a supplemental assessment roll with respect to Levy 5604 as such levy pertains to the property embraced within the plat of Sunny Acres :' 3rd Addition and shall calculate the proper amount to be specially assessed against each and every lot within said plat. The motion for the adoption of the foregoing Resolution was duly seconded by 10 Councilman Neils , and upon vote being taken thereon, the following voted in favor thereof: yor Hilde, Councilmen Hunt, Neils, Se_i bol d and Spaeth The following voted against or abstained: none Whereupon the Resolution was declared duly passed and adopted.
