HomeMy WebLinkAboutCity Council Resolution 1975-419W W CITY OF PLYMOUTH Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of Plymouth, Minnesota, was od n tie 18th day of August , 19 75 The following members were present: The following members were a sent: none Councilman Spaeth introduced the following Resolution and moved Its adoption: RESOLUTION NO. 75-419 A RESOLUTION -DIRECTING THE PREPARATION OF ASSESSMENT ROLLS SUNNY ACRES THIRD ADDITION WHEREAS, the City Council did, on the 2nd day of October, 1969 adopt Resolution No. 69-360 confirming and adopting the assessment for Southwest Improvement Project No. 68-1E, otherwise identified as Levy 4747 and, WHEREAS, following the adoption of such roll such levy was certified to the Hennepin County Auditor, and WHEREAS, thereafter a portion of the area so assessed was platted as Sunny Acres 3rd .Addition, which plat consisted of 7 lots, numbered 1 through 7 and, WHEREAS, following the acceptance and filing of such plat, the total assessment levied against the property within such plat should have been proportionately divided amongst and spread upon each of the 7 lots comprising such plat and, WHEREAS, an error was made in that the total assessment pertaining to such plat was levied upon and against Lot 1 and nothing was levied upon and against Lots 2 through 7, and, WHEREAS, in order to correct such error, a supplemental assessment is necessary so that all lots in such plat receive their proportionate share of such levy, NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA 1. Pursuant to the provisions of Section 429.071, Subdivision 1, Minnesota Statutes, it is hereby determined that a supplemental assessment of Levy 4747 is necessary in order to correct mistakes in such levy relating to the subdivision known as Sunny Acres 3rd Addition. 2. The City Clerk shall forthwith prepare a supplementarassessment roll with respect to Levy 4747 as such levy pertains to the property embraced within the plat of Sunny Acres 3rd Addition and shall calculate the proper amount to be specially assessed against each and every lot within said plat. The motion for the adoption of the foregoing Resolution was duly seconded by Councilman Neilsand upon vote being taken thereon, the following,voted in favor t ereo : _ ayor Hilde, Councilmen Hunt, Neils, Seibold and Spaeth The following voted against or abstained: none Whereupon the Resolution was declared duly passed and adopted.
