RESOLUTION NO. 75-319
AUTHORIZING COMMENCING CONDEMNATION PROCEEDINGS FOR PROJECT NO. 306`
WHEREAS, upon receipt of a petition from the adjacent land owners on Xenium Lane
south of the Chicago -Northwestern Railroad tracks, dated June 11, 1974, the City
Council undertook the construction of sanitary sewer, water main, storm sewer
and street improvements on Xenium Lane, and j
WHEREAS, the owner of the property on the cast side of railroad tracks on the
east side of Xenium Lane. legally described as Parcel 3035, Plat 43734, Parcel 3502,
Plat 43734, Parcel 4802, Plat 43727 and have received Preliminary Plat approval for
said property, to be known as Reinhard Industrial Park, which plat included the
street right-of-way for 12th Avenue North, and Xenium Lane, and
WHEREAS, the City has tried but has been unable to receive the necessary easements
required for Project No. 306, and the Council finds it to be necessary, proper and
expedient in the interest of the public health, convenience and general welfare of
the citizens of the City of Plymouth, for the City to acquire permanent easements;'
NOW, THEREFORE; BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH,
MINNESOTA THAT THE CITY ATTORNEY IS HEREBY AUTHORIZED TO COMMENCE CONDEMNATION
PROCEEDINGS FOR PROJECT NO. 306 FOR THE FOLLOWING DESCRIBED PARCELS OF PROPERTY:
PARCEL ONE
Description of Parcel:
That part of Northwest 1/4 of Northeast 1/4 of Section 34, Township 118. Range 22,
described as follows: Beginning at the Southwest corner of said Northwest 114 of
the Northeast 1/4; thence easterly along the South line of said Northwest 1/4 cf
the Northeast 1/4, 1282.50 feet; thence Northerly and parallel with the West line
of said Northwest 1/4 of the Northeast 1/4, 725.00 feet to a point; thence
Westerly and parallel with the South line of said Northwest 1/4 of the Northeast 1/4,
175.00 feet to a point on a 60.00 foot radius curve, the center of cii.le of said
curve lies 60.00 feet West on the extension of the last described line; thence' -
Northerly and Westerly along said curve 157.08 feet, central angle 150 degrees;
thence Westerly and parallel with the South Line of said Northwest 1/4 of the
Northeast 1/4, 995.54 feet to the West line of said Northwest 1/4 of the pro:. oast 1/4;
thence Southerly along the West line of said Northwest 1/4 of the Northeast ii4,
755.00 feet to the point of beginning.

Description of Easements:
A permanent easement for street and utility purposes over, under, across and through
the West 30 feet of the aforedescribed parcel, and
A temporary easement for street and utility construction purposes over, under, across
and through the East 60 feet of the West 90 feet of the aforedescribed parcel, and
A 20 foot wide permanent easement for storm sewer and storm drainage purposes over,
under, across and through part of the aforedescribed parcel, the centerline of said
easement being described as follows: Commencing at a point on the West line of the
Northwest 1/4 of the Northeast 1/4 of Section 34, Township 118, Ranae 22, said point
being located 705.0 feet North of the Southwest corner of said Northwest 1/4 of the
Northeast 1/4; thence East, parallel with the South line of said Northwest 1/4 of
the Northeast 1/4, to the East line of the aforedescribed parcel and there
terminating, and
A temporary easement for storm sewer and storm drainage construction purposes
consisting of a strip of land 100 feet in width and centered on the aforedescribed
center line.
Said temporary construction easements shall expire on July 31, 1976, or upon
completion of construction, whichever occurs first.
PARCEL TWO
Description of Parcel:
That part of the Northwest 1/4 of the Northeast 1/4 of Section 34, Township 118,
Range 24, Hennepin County. Minnesota, lying Northerly and Easterly of the following
described line: Beginning at the Southwest corner of said Northwest 1/4 of the
Northeast 1/4; thence Easterly along the South Line of said Northwest 1/4 of the
Northeast 1/4, 1282.50 feet; thence Northerly and parallel with the West line of
said Northwest 1/4 of the Northeast 1/4, 725.00 feet to a point; thence Westerly
and parallel with the South line of said Northwest 1/4 of the Northeast 1/4,
175.00 feet to a point on a 60.00 foot radius curve, the center of circle of
said curve =1:-ies 60.00 feet West on the extension of the last described line;
thence Northerly and Westerly along said curve 157.08 feet, central angle 150 degrees;

PARCEL .THREE
Description of Parcel:
That part of the Northeast 1/4 of the Northeast 1/4 of Section 34, Township 118,
Range 22, lying Westerly of the plat of Glen Echo Lake Addition.
Description of Easements:
A 20 foot wide permanent easement for storm sewer and storm drainage purposes
over, under, across and through part of the aforedescribed parcel, the centerline
of said easement being described as follows: Commencing at a_point on the West
line of the Northwest 1/4 of the Northeast 1/4 of said Section 34, said point
being located 705.0 feet North of the Southwest corner of said Northwest 1/4 of
the Northeast 1/4; thence East parallel with the South line of the North One -Half
of the Northeast 1/4 of said Section 34 to a point which is 460 feet East of the
West line of the Northeast 1/4 of the Northeast 1/4 of said Section 34 and there
terminating, and
A temporary easement for storm sewer and storm drainage construction purposes over,
under, across and through the South; 200 feet of the North 805 feet of the West 460
feet of the Northeast 1/4 of the Northeast 1/4 of ,said Section 34.
Said temporary construction easement shall expire on July 31, 1976, or upon
completion of construction, whichever occurs first.
The motion for the adoption of the foregoing Resolution was duly seconded by
Councilman Hunt, and upon vote being taken thereon, the following voted in favor
thereof: Mayor Hilde, Councilmen Hunt, Neils, and Spaeth. The following voted
against or abstained: none. Whereupon the Resolution was declared duly passed
and adopted.
