CITY OF PLYMOUTH
Pursuant to due call and notice thereof, a regular meeting of the City
Council of the City of Plymouth, Minnesota, was held on Me 16th day of
June 19 75 . The following members were present:

RESOLUTION NO. 75-316
ADOPTION POLICY REGARDING UNDERTAKING
OF PETITIONED CAPITAL IMPROVEMENTS
WHEREAS, the City of Plymouth has adopted a 5 -Year Capital Improvement
Program (CIP) which sets forth the City's planned capital
projects including financing plans, and
WHEREAS, the CIP is designed to insure both the City's orderly physical
development, as well as its ability and capacity to responsibly
finance such development, and
WHEREAS, due to other development in the City, the Council receives
petitions for public improvements which a. --e not included within
the CIP, and
WHEREAS, petitioned projects must be carefully evaluated in terms of
both their compatibility with the adopted CIP: as well as the
City's capacity to finance the petitioned improvements in an
orderly fashion, and
WHEREAS, the Council has determined that a policy is required In order
to establish reasonable procedures for the review of both
petitioned public improvement projects, in order that they
may be properly coordinated within the framework of the 5 -year
CIP, and the City's ability to properly arrange financing; :or
such projects.
NOW THEREFORE BF IT HEREBY RESOLVED by the City Council of the City of
Plymouth that in order to provide the City with the appropriate
time to fully evaluate and undertake petitioned public improve-
ment projects, the following criteria are hereby established:
Petitions for public improvement projects to be undertaken
and financed by the City must be submitted to the City
Council not later than February 1 of the year in which
the project is requested for construction.
2. Petitions submitted after February 1 shall not be scheduled
for construction until the following construction season.

3. In reviewing petitions for public improvements, the Council
will have prepared the necessary engineering feasibility
report in order to determine:
a. That all improvements lacking in the particular
area, including water, sanitary sewer, storm
drainage, permanent streets and curb and gutter,
are included.
b. That the project area includes the logical area
to be served based upon the City's utility plans,
as well as the development occurring in the
proposed project area.
4. The staff shall report upon the City's ability to finance
all petitioned improvement projects, which report shall
include:
a. The City's ability to finance the project through
the sale of bonds, considering other financial
commitments.
b. The probable assessment amounts, including assess-
ment length, on the property benefiting from the
improvements.
C. Present status of taxes and assessments on the
property, including any delinquent taxes and
assessments.
d. The ability of the petit_Dner to provide the
necessary bonds and/or cash deposits required by
City development regulations.
The motion for the adoption of th foregoing Resolution was duly
seconded by Councilman Neils _, and upon vote being taken
thereon, the following voted in favor thereof: Mayor I111de,
Councilmen Hunt, Neils Seibold and Spaeth
The following voted against or abstained: None
Whereupon the Resolution was declared duly passed and adopted.
