Hilde, uncal an,Hunt Neils, Seibold and Spaeth . following mem ers were absent: none The { Councilman Seibold " introduced the following Resolution and moved IS, adoption: RESOLUTION NO. 75.403'. AUTHORIZING THE VACATIN Ot A PORTION OF EAST MEDICINE LAKE BLVD; WHEREAS, a petition to vacate East Medicine Lake Blvd.from 36th Avenue North too Country Rood,9 has. been received by the City Council'.from, the property owners adjacent to East Medicine Lake Blvd.between 36th Avenue North and County Road 9; and WHEREAS, a -public hearing with respect to said vacation was held on June 2, 1975, 3 "in -accordance with Minnesota Statutes, 412.851, as amended; and WHEREAS, a notice of publication of said hearing was published and posted two weeks, prior to the meeting of June 2, 1975; and _WHEREAS, the Council did hold a public hearing on June 2, 1975 to inform any and all interested parties relevant to the vacation of East Medicine Lake Boulevard . between 36th.Avenue North and County,.9; and WHEREAS,, it was determined by the City Council that with the completion of Zachary Lane between 36th Avenue North and County Road 9, a certain portion of East Medicine Lake Blvd.is not needed for public street, NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, as follows: .� 1. That that part of East Medicine Lake Blvd.lying North of the South line of the Southeast Quarter of the Southeast Quarter and South of the North line of the South One-half of the Southeast Quarter, all in Section 14, Township 118, Range 22, be vacated as a public roadway. 2. That said vacation shall not affect the authority of any person, corporation or 31 municipality owning or controlling electric or telephone poles and lines, gas and sewer lines, or water pipes, mains and hydrants thereon or thereunder, to continue maintaining the same or to enter upon such way or portion thereof vacated to repair, replace, remove or otherwise attend thereto. A, The motion for the adoption of the foregoing Resolution was duly seconded by Councilman Hunt, and upon vote being taken thereon, the following voted in favor thereof: Mayor Hilde, Councilmen Hunt, Neils, Seibold and Spaeth. The following voted against or abstained: none. Whereupon the Resolution was declared duly passed and adopted. ee* ��s eee
