NeilsS ibold and Spaeth. he o owing mem ers were a sent: none introduced the following Resolution and moved s ado on: RESOLUTION NO. 75-299 AUTHORIZING ACQUISITION OF PLAT 44080, PARCEL 5300, FOR CITY PARK PURPOSES WHEREAS, the City of Plymouth, on February 24, 1972, entered into an opt'.on contract with Thomas S. Purnick, to purchase a part of Plat 44080, Parcel 5300 (hereafter "subject property") for park purposes as a part of the 1972,LAWCON Project; and WHEREAS, the City of Plymouth paid $250.00 as consideration for said option contract; and WHEREAS, on November 22, 1972, the City of Plymouth exercised its right to purchase the'"subject property by notifying the owner thereof of such intention in writing and by tendering the balance due under the terms of the constract: and WHEREAS, the owner of the subject property failed to comply with the terms of the option contract, in that he did not deliv er to the City of Plymouth a Warranty Deed and a receipt showing current and delinquent taxes were paid up; and WHEREAS, the City of Plymouth has been notified that the subject property has forfeited to the State of Minnesota for non-payment of taxes; and WHEREAS, th,: City of Plymouth is still desirous of obtaining the subject property for use in its park system; NOW, THEREFORE, BE .-T RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH AS FOLLOWS: 1. That the Mayor and Manager execute an "Application by Governmental Subdivision for Conveyance of Tax -Forfeited Lands" and submit the same to the Hennepin County Finance Division, Tax Forfeited Land Unit. 2. Th?, the Director of Planning and the City Attorney lake all steps appropriate to insure successful action by the Hennepin County Board and the Minnesota Commissioner of Taxation with respect to said application. a 0 Page Two Resolution No. 75-299 The ::.otion for the adoption of the foregoing Resolution was duly seconded by Councilman Spaeth, and upon vote being taken thereon, the following voted in favor thereof: Mayor Hilde, Councilmen Hunt, Neils, Seibold and Spaeth. The following voted against or abstained: none. Whereupon the Resolution was declared duly passed and adopted.
