Thefo owing mem ers were absent: None, t:* HHr art _Councilman Hunt introduced the following Resolution and moved s adoption: RESOLUTION NO. 75-258 CONFIRMING AND ADOPTING AS5L3SMENT FOR LOT 1. BLOCK 1. GLEASON ?RAILS WHEREAS, George Kreatz and Robert Kreatz as developers of Gleason Trail Addition in the City of Plymouth, Minnesota have executed a development contract which they have agreed to accept water and sanitary sewer assessments in the amount Of $11.860.00, NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH. MINNESOTA: 1. Based on Levy 4747 -Southwest Sewer and Water Improvement - Res. 69-360. adopted October 2. 1969 by the City Council the rate was established for sewer, water, street restoration at $19.00/foot, and together with accrued interest at the rate of 8% the rate is now established at $29.00/foot for said Lot 1, Block 1. Gleason Trails Addition. Therefore, the assessment forsanitary sewer. water and street restoration (laterals) equals 350 feet X $29.00/foot equals $10,150.00; and the water main area charges are equal to 2.Z acres at $750.00/acre for a total of $1,710.00; thereby making the total assessment $11.860.00. 2. Connection charges shall be those prevailing at time of connection for both sewer and water main. BE IT FURTHER RESOLVED' that the aforementioned assessments are affirmed, adopted and confirmed, and BE IT FURTHER RESOLVED that said assessments shall be certified to by the City Clerk and filed in her office and shall thereupon be and constitute the special assessments for Lot 1. Block 1, Gleason Trails Addition for sanitary sewer, water main and street restoration (lateral) and water area charges, and BE IT FURTHER RESOLVED that the amounts assessed against the subject parcel land shall bear interest from May 19. 1975 in accordance with the terms of the development contract until the same has been paid at the rate of 8% per annum. and BE IT FURTHER RESOLVED that such assessments shall be payable in ten (10) equal annual installments payable on the first day of January each year beginning the year 1976 and shall continue until said installments have been paid, each installment to be collected with taxes collectable during the same year by the County Auditor Reso. 75-258 Page 2 • and to the first installment when due shall be added interest on the entire assessment from May 5, 1975 to December 31, 1976. To each subsequent installment shall be added interest for one (1) year upon all unpaid installments. and BE IT FURTHER RESOLVED that the City Clerk is hereby authorized and directed to make up and file in the office of the County Auditor of the County of Hennepin a certified statement of the amount of all such unpaid assessments and the amount which shall be due thereon on the first day of January each year. The motion for the adoption of the foregoing Resolution was duly seconded by Councilman Seibold. and upon vote being taken thereon, the following voted in favor thereof: Mayor Hilde. Councilmen Hunt, Hems. Seibold and Spaeth. Whereupon the Resolution was declared duly passed and adopted. arrt • 0
