RESOLUTION NO. 75-246 CONDEMNATION STORM SEWER EASEMENT PROJECT NO. 406 WHEREAS, a resolution of the City Council adopted the 18th day of March, 1974 fixed a date for a Council hearing on the proposed improvement of storm drainage district BC -42 as shown in the Storm Drainage Plan for Plymouth, Minnesota March 1973 by the construction of storm drainage pipes and all necessary appurtenances, and WHEREAS, under this improvement Project No. 406, it was required to construct a storm sewer pipe along the east and south sides of Lot 13, Block 3, Elmhurst Gardens Addition, necessitat an easement along said boundaries, and WHEREAS, the City of Plymouth has not been able to negotiate with the property owner for vaid easement, NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA: that the City Attorney is authorized to commence condemnationproceedings for storm drainage ; easement along the south and east sides of Lot 13, Block 3, Elmhurst Gardens Addition for public improvement Project No. 406. The motion for the adoption of the foregoing Resolution was duly seconded by Councilman Seibold, and upon vote being taken theron, the following voted in favor thereof: Mayor Hilde, Councilmen Neils, Seibold and Speath. The following voted against or abstained: none. Whereupon the Resolution was declared duly passed and adopted.
