Pursuanttodue call and notice thereof, a ____regular meeting of the City
Council of the City of Plymouth, Minnesota, was heid—an ti -ie 5th day of

Councilman Hunt introduced the following Resolution and moved
its adoption:
RESOLUTION NO. 75-229
DIVIDING PLAT 43713, PARCEL 1220 INTO TWO PARCELS
FRED J. MENGELKOCH (A-613)
WHEREAS, Sagamore Apartments own land at the northeast corner of County Road 9
and Trenton Lane, and have requested a subdivision variance, and
WHEREAS, the City Planning Commission has reviewed said request, and
WHEREAS, the City Council has now determined that the subdivision of said
land into two parcels, one of which would contain less than five (5) acres,
would not interfere with the purpose of the Subdivision Regulations of the
City of Plymouth and that a refusal to permit such subdivision would create
an unnecessary hardship on such owner.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH,
MINNESOTA as follows:
1. Compliance with the provisions of Section 462.358, Subdivision 4,
Minnesota Statutes, and Section 9.02 of Chapter VII of the City Code
relating to conveyances by metes and bounds of parcels of land
containing an area of land less than five (5) acres is hereby waived
with respect to the following described parcels:
Parcel B
Plat 43713 Parcel 122C. That part of the East 1/2 of the West 1/2 of the
Northwest 1/4 lying North of State Highway 55 and the West 1/2 of the Northeast
1/4 of the Northwest 1/4, Section 13, Township 118, Range 22, except roads.
Parcel C
Plat 43713 Parcel 1220. All that part of the West 1/2 of the Northeast 1/4 of
Section 13, Township 118, Range 22 described as commencing at the Northeast
corner of said West 1/2 of the Northeast 1/4 of the Northwest 1/4; thence
South 20 58' 22" West along the East line of said West 1/2 of the Northeast
1/4 of the Northwest 1/4 a distance of 1043.91 feet to the actual point of
beginning of land to be described; thence continuing South 20 58' 22" West
along the East line of said West 1/2 of the Northeast 1/4 of the Northwest
1/4 a distance of 114.85 feet; thence So..'hwesterly on a curve concave to
the North having a radius of 10,000.0 feet and a chord bearing of South
880 31' 15" West a distance of 203.75 feet; thence Northeasterly on a curve
concave to the Northwest having a radius of 250.0 feet and a chord bearing

• of North 600 13' 10" East a distance of 247.71 feet to the actual point of
beginning. Subject to easement for sewer and water main purposes.
Subject to restrictions, reservations and easements of record, if any.
2. The City Clerk is directed to prepare a certified copy of this
resolution for recording purposes.
The motion for the adoption of the foregoing Resolution was duly seconded by
Councilman Seibold, and upon vote being taken thereon, the following voted in
favor thereof: Mayor Hilde, Councilmen Hunt, Seibold and Spaeth.
The following voted against or abstained: None.
Whereupon the Resolution was declared duly passed and adopted.
