HomeMy WebLinkAboutCity Council Resolution 1975-203CITY OF PLYMOUTH Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of Plymouth, Minnesota was held—on the qday of April 19 75 . The following members were present Acting Mayor Spaeth, Cnimrilman Nails The fo owing members were absent Mayor Hilde and Acting Mayor Hunt Councilman Seibold introduced the following Resolution and moved its adoption. RESOLUTION NO. 75-203 DECLARING ADEQUACY OF PETITION AND ORDERING PREPARATION OF REPORT PLYMOUTH FREEWAY CENTER PROJECT NO. 518 WHEREAS, the City Council has received a petition dated April 21, 1975 from the developers of the Plymouth Freeway Center for the installation of streets and utilities for the Plymouth ' Freeway Center Addition, WHEREAS, said petition waives all rights to public improvement hearings and special assessment hearings, NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA: • 1. A certain petition requesting the improvement of the streets in the Plymouth Freeway Center Addition (legally described as that part of the NWU of the SWh of Section 22, Township 118, Range 22, Hennepin County, Minnesota lying northerly of State Trunk Highway':; No. 55 and westerly of Interstate Highway No. 494 and westerly of the east line of the west 48.88 rods thereof) by the installation of sanitary sewer, water main, 9 ton bituminous streets with concrete curb and gutter and necessary storm drainage facilities,` filed with the Council on April 21, 1975, is hereby declared to be signed by the required percentage of owners of the property affected thereby. This declaration is made in conformance to the Minnesota Statutes Section 429.035. 2. The petitioner waives all rights to public improvement hearings and special assessment hearings. 3. The petition is hereby referred to Bonestroo, Rosene, Anderlik and Associates, Inc. and he is instructed to report to the Council with all convenient speed advising the Council in a preliminary way as to whether the proposed improvement is feasible and as to whether it should best be made as proposed or in conjunction with some other improvement and the estimated cost of the improvement as recommended. 4. The cost of said improvement is to be financed from the construction fund. f' The motion for the adoption of the foregoing Resolution was duly seconded by Councilman, Neils, and upon vote being taken thereon, the following voted in favor thereof: Acting Mayor Spaeth, Councilmen Neils and Seibold. The following voted against or t abstained: none. Whereupon the Resolution was declared duly passed and adopted. i
