RESOLUTION NO. 75-185
APPROVING LOT DIVISIOd OF UNPLATTED PROPERTY AT 330 ZINNIA LANE
WHEREAS, Fritz J. Gullickson, who owns land at 330 Zinnia Lane of the City of
Plymouth, has requested a subdivision variance, and
WHEREAS, the City Planning Commission has reviewed said request, and
WHEREAS, the City Council has now determined that the'subdivision of said land
into three parcels, one of which would contain less than five (5) acres, would not
interfere with the purposes of the Subdivision Regulations of the City of Plymouth
and that a refusal to permit such subdivision would create an unnecessary hardship on
such owner,
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY -COUNCIL OF THE CITY OF PLYMOUTH,
MINNESOTA AS FOLLOWS:
1. Compliance with the provisions of Section 462.358, Subdivision 4, Minnesota.
Statutes, and Section 9.02 of Chapter VII of the City Code relating to con-
veyances by metes and bounds of parcels of land containing an area of land
less than five (5) acres is hereby waived with respect to the following
described parcels:
PARCEL A
The Southerly 112.00 feet of the Northerly 272.00 feet of the Westerly 240 feet
of the Southeast Quarter of the Northeast.Quarter of the Southwest Quarter of Section
34, Township 118, Range 22, Hennepin County, Minnesota.
Subject to an easement for roadway purposes over and across the Westerly 30 feet
thereof.
PARCEL B
The Sjutherly 103 feet of the Northerly 375 feet of the Westerly 240 feet
of the Southeast Quarter of the Northeast Quarter of the Southwest Quarter of
Section 34, Township 118, Range 22.
Subject to an easement for roadway purposes over and across the Westerly 30 feet
thereof.
• PARCEL C
That part of the Southeast Quarter of the Northeast Quarter of the Southwest
Quarter of Section 34, Township 118 North, Range 22 West of the 5th Principal
Meridian, Hennepin County, Minnesota, described as follows: Beginning at a point
in the West line of said Southeast Quarter of the Northeast Quarter of the Southwest
Quarter distant 460.9 feet South of the Northwest corner thereof; thence deflecting
to the left 80 degrees, 13 minutes and running Southeasterly 124.1 feet; thence
along a curve to the left having a radius of 322.62 feet a distance of 145.4
feet more or less to a point which is 268 feet East of the West line of said
Southeast Quarter of the Northeast Quarter of the Southwest Quarter; thence
North parallel with the West line of said Southeast Quarter of the Northeast
Quarter of the Southwest Quarter 25.1 feet more or less to a point which is
451.4 feet South of the North line of said Southeast Quarter of the Northeast
Quarter of the Southwest Quarter; thence Northwesterly 82 feet more or less to
a point which is 240 feet East of the West line of said Southeast Quarter of the
Northeast Quarter of the Southwest Quarter and 375 feet South of the North line of
said Southeast Quarter of the Northeast Quarter of the Southwest Quarter; thence
West parallel with the North line of said Southeast Quarter of the Northeast Quarter
of the Southwest Quarter 240 feet to the West line thereof; thence South along
said West line 85.9 feet to point of beginning.
Subject to an easement for roadway purposes over and across the Westerly 30 feet
thereof.
• 2. That a seven foot width variance for Parcel B be granted.
3. That a five foot width variance for Parcel C be granted.
4. That any sewer and water connections be added at the owner's expense.
5. The City Clerk is directed to prepare a certified copy of this resolution
for recording purposes.
The motion for the adoption of the foregoing Resolution was duly seconded by
Councilman Spaeth, and upon vote being taken thereon, the following voted in favor
thereof: Acting Mayor Hunt, Councilmen Neils, Seibold and Spaeth. The following
voted against or abstained: none. Whereupon the Resolution was declared duly
passed and adopted.
