HomeMy WebLinkAboutCity Council Resolution 2009-128CITY OF PLYMOUTH RESOLUTION 2009-128 A RESOLUTION TO APPROVE A CONDITIONAL USE PERMIT TO ALLOW INSTALLATION OF AN EIGHT -FOOT FENCE AT 18415 1 1T" AVENUE NORTH (2009010) WHEREAS, Cynthia Melin and Matthew Melin have requested approval of a conditional use permit for an eight -foot fence to be located on the following described property: Lot 2, Block 6, Hadley Hills, Hennepin County, Minnesota. WHEREAS, the Planning Commission has reviewed said request at a duly called public hearing and recommends approval. NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Cynthia and Matthew Melin for a conditional use permit at 18415 11th Avenue North, subject to the following conditions: A conditional use permit is approved to allow an eight -foot fence installed along the rear property line, as shown on the application and plans received by the City on April 20, 2009, except as may be amended by this resolution with the finding that all applicable conditional use permit standards have been met. 2. The proiect requires a separate building permit prior to installation of the fence. The application for a building permit shall include a structural design to resist deisgn wind loading that is certified by an engineer licensed in the State of Minnesota. The applicant shall stake and string the property line prior to the footings inspection for verification of property line. 4. The fence shall be placed on the south property line. The finished face of the fence shall abut adjoining properties. 6. The permit is subject to all applicable codes, regulations and ordinances, and violation thereof shall be grounds for revocation. 7. The conditional use permit shall expire one year from the date of approval, unless the project is substantially completed or an extension is applied for and granted, as regulated under Sections 21015.07 of the Zoning Ordinance.
