Councilman Spaeth _ introduced the following Resolution and moved

RESOLUTION NO. 75-144
DENIAL SITE PLAN FOR APARTMENT COMPLEX/
DANIEL RALICKI AND DR. ARNOLD LEO'iARD
WHEREAS. Daniel Ralicki and Dr. Arnold Leonard hive presented a project for site
plan approval proposing 96 living units on 5.2 Diet acres of land located on South
Shore Drive, and
WHEREAS, the petitioners in this matter base their request for 96 units on 5.2 net
acres upon approval action of the City Council in 1969, and
• WHEREAS, current zoning standards of the City permit not more than 60 units on the
said 5.2 net acre parcel for a project of the design proposed.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH
that it should and hereby does find as follows:
1. Resolution Number 72-292 provides protection from Zoning Ordinance
Amendments subsequent to approval only upon prompt prosecution of
project plans. The six years between approval of the subject
project and the now proposed prosecutiod is not found to be prompt
within the purview of the subject resolution.
2. The approval of 96 units for the subject 5.2 acres would constitute
a variance of existing zoning standards in excess of fifty percent (50X).
3. No unique site features nor hardships are found as basis for a
variance from existing zoning standards with respect to dwelling
unit density.
4. Section 19, Subdivision 2, of the Zoning Ordinance of the City of
Plymouth specifies that variance can not be granted based exclusively
upon economic hardship.
RESOLVED FURTHER, that the request of the petitioners for approval of a site plan
for 96 units on 5.2 net acres should and hereby is denied, and said petitioners
• are directed to develop the subject site in accordance with zoning standards of
the City currently in effect.
The motion. for. the adop 4d,n:of the foregoing Resolution was duly seconded by
1purtciltaan Seibold, and;-, upon vote being taken theron, the following voted in
favor: thereof: 'Aoting.(�ayor Hunt, Councilmen Seibold and Spaeth. fhe following
voted agaiest or abstained= None. Whereupon the Resolution was declared duly
passed and adopted.
