Pursuant to due call and notice thereof, a regular meeting of the City
Council of the City of Plymouth, Minnesota, was hold on the 17 day
of March 19 75The following members were present: mayor lde,

Councilman Spaeth introduced the following Resolution and
moved its adoption:
RESOLUTION NO. 75-138
ASSESSMENT CORRECTION - LOTS 1 AND 2, BLOCK 2, ELMHHURST HEIGHTS ADDITION
WHEREAS, our records indicate that Lots 1 and 2, Block 2, Elmhurst Heights Addition,
are separate parcels and taxed accordingly, and therefore were assessed each fnr
water area type assessments and REC charges, and
WHEREAS, in order to serve Lot 1, from the water main on 28th Avenue it necessitates
building the water service line across Lot 2, thereby making it unbuildable.
�. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH,
MINNESOTA, that the area type water assessment and REC charge for Lot 2, Block 2,
Elmhurst Heights Addition assessed under Levy 5602 is hereby removed subject to the
property owner making application to combine said Lots 1 and 2 into one parcel,
BE IT FURTHER RESOLVED, that the Finance Director is authorized to reimburse the
property owner for any water area charges paid on Lot 2 with funds to come from
the special assessment fund.
The motion for the adoption of the foregoing Resoluti;,c: was duly seconded by
Councilman Neils and upon vote being taken thereon, the
