Pursuant to due call and notice thereof, a meeting of the City
Council of the City of Plymouth, Minnesota, was%e on t e 3rd day
of March _ , 19 75 . The following members were present: Mayor Hilde,
Tne toilowing members were absent: none
Councilman Neils introduced the following Resolution and
moved its adoption:
RESOLUTION NO. 75-120
APPROVING STIPULATION - PINETREE POND
WK�RFAS, the City of Plyrouth has been involved in District Court litigation pursuant
to an action brought by Glen S. Swain and others with respect to the City's allegedly
damagir:.g the plaintiffs' property by illegally diverting water to the Pinetree Pond,
and
WHEREAS, the attorneys for the City and the plaintiff have proposed a stipulation
of settlement with respect to all matters involved in present litigation, which
stipulation has been reviewed by this Council,
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH
that the Mayor and Manager be and the same are hereby authorized and directed to
execute on behalf of the City the stipulation of settlement as recommended by, the
City's Attorney, AND FURTHER, that the sum of $8,000 be appropriated from Project
No. 116 to be paid in accordance with the terms of the stipulation of settlement.
The motion for the adoption of the foregoing Resolution was duly seconded by
