Pursuant to due call and notice thereof, a regular meeting of the City
Council of the City of Plymouth. Minnesota, washeld on the 2nd day
of December 19 74 The following members were present: Mayor

Councilman Spaeth introduced the following Resolution and
moved its adoption:
RESOLUTION NO. 74-578
APPROVING REFUND AND ORDERING RECALCULATION OF SPECIAL ASSESSMENTS- CAREY ADDITION
WHEREAS. tare City of Plymouth, (City) and Mr. Francis Carey, (Developer), have +
entered into a development contract dated November 30, 1971, and
WHEREAS, said development contract included the down payment of 25% of the estimated
cost of public utility and street improvements amounting $8,193.75, and
WHEREAS, said utility and street improvements were constructed under Public Improvement
Prc,jects No. 127, 142 and 921 and assessed as shown on the attached Exhibit A; and that
the actual amount of the 25% down payment is calculated to be $7,931.71.
WHEREAS, said assessments did not give Mr. Carey credit for his previously paid 25% 6
down payment of $8,193.75, and i
WHEREAS, Lot 1,Carey Addition has been sold, '
NOW, THEREFURE. BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH,
MINNESOTA that Mr. Francis Carey be refunded $262.,04 ($8,193.75-$7,931.71) and �
BE IT FURTHER RESOLVED that the special assessments be recalculated on Lots 2 through
6, Carey Addition to reflect the previously paid $7,931.71.
The motion for the adoption of the foregoing Resolution was duly seconded by

Whereupon the Resolution was declared duly passe% and adopted.
