RESOLUTION NO. 74-574
WAIVING THE REQUIREMENT OF SECTION 462.358, SUBDIVISION 4, MINNESOTA STATUTES.
AND SECTION 9.02 OF CHAPTER VII OF THE CITY CODE RELATIVE TO CONVEYANCES
BY METES AND BOUNDS OF PARCELS OF LAND CONTAINING LESS THAN FIVE ACRES,
PER REQUEST OF CITY OF PLYMOUTH - ROBERT L. SORENSON PROPERTY
WHEREAS, the City of Plymouth has requested that Parcel 5410, Plat 44080 (Lots
10 and 11, Block 3, Elmhurst Gateway 2nd Addition as combined) be further sub-
divided. and
WHEREAS. the City staff has reviewed said request and recommends approval, and
WHEREAS, the City Council has now determined that the subdivision of said parcel
which contains less than five (5) acres would not interfere with the purposes
of the Subdivision Regulations of the City of Plymouth and that a refusal to permit
such subdivision would create an unnecessary hardship on such owner.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH
as follows:
t. Compliance with the provisions of Section 462.358, Subdivision 4, Minnesota
Statutes, and Chapter VII of the City Code as related to the division or con-
solidation of platted lots is hereby approved with respect to the following
described parcels:
PARCEL A
The easterly 110 feet of Lots 10 and 11. Block 3, Elmhurst Gateway 2nd
Addition according to the plat thereof on file and of record in the office
of the Register of Deeds in and for Hennepin County. Minnesota. subject
to easements of record, if any.
PARCEL B
That part of Lots 10 and 11, Block 3, Elmhurst Gateway 2nd lying west of
the easterly 110 feet of said Lots 10 and 11. according to the plat thereof
• on file and of record 1n the office of the Register of Deeds in and for Hennepin
County, Minnesota, subject to easements of record, if any.
2. The City Clerk 1s directed to prepare a certified copy of this resolution for
recording purposes.
