Councilman Spaeth introduced the following Resolution and moved

RESOLUTION NO. 74-570
WAIVING THE RE4UIREMENT OF SECTION 462.358, SUBDIVISION 4,`MINNESOTA STATUTES,
AND SECTION 9.02 OF CHAPTER VII OF THE CITY CODE RELATIVE TO CONVEYANCES
BY METES AND BOUNDS OF PARCELS OF LAND CONTAINING LESS THAN FIVE ACRES,
PER REQUEST OF JUEL SVENKERUD - LAKE PARK ACRES
WWEREAS, Juel SvenkeruC. owner of Lot 3, Lake Park Acres, has requested that this
lot be further subdivided, and
WHEREAS, the City K:aff has reviewed said request and recommends approval, and
WHEPEAS, the City Council has r•nr determined that the subdivision of said parcel
whiei contains less fl ar, five (5) acres would not interfere with the purposes of the
Subdivision Regulations of the City of Plymouth and that a refusal to permit such
subdivision would create an unnecessary hardship on such owner,
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH
as follows
1. Compliance with the provisions of Section 462.358, Subdivision 4, Minnesota
Statutes, and Chapter VII of the City Code as related to the division or
consolidation of platted lots is hereby approved with respect to the following
described parcels:
PARCEL A
The South 186.30 feet of Lot 3, Lake Park Acres, according to the plat
thereof on file and of record 1n the office of the Register of Deeds in
and for Hennepin County, Minnesota, as measured along the bast and West
lines thereof. Subject to easements of record, if any.
PARCEL B
That part of Lot 3, Lake Park Acres, according to the plat thereof on file
and of record in the office of the Register of Deeds in and for Hennepin
County, Minnesota lying north of the south 186.30 feet, as measured along
the east and west lines thereof. Subject to easements of record, if any.
2. The City Clerk is directed to prepare a certified copy of this resolution for
in 1Vp 14-576
recording purposes.
The motion for the adoption of the foregoing resolution was duly seconded by
Councilman Seibold and upon vete being taken thereon, the following voted in
favor thereof. Mayor Hilda, Councilmen Seibold and Spaeth. The following voted
against or abstained: none. Whereupon the resolution was declared duly passed
and adopted.
