The following members were prasent: Mayor Hi1de, Councilmen Neils and SefF d The following members were absent: Councilmen Hunt and Spaeth tr* t:t Mayor Hi1de introduced the following Resolutien and moved Its adoption: RESOLUTION NO. 74-556 APPROVING SIGN VARIANCE - RICK KUPERFIELD WHEREAS, Rick Kumerfield, dba Mr. K's Menswear, Inc., has made application to the Board of Zoning Adjustment for variance of the provisions of Section 17, Subdivision 7, d and r, to allow the addition to a sign non -conforming as �o setback, and WHEREAS, the Board of Zoning Adjustment, by action October 8, 1974, denied the variance, and • WHEREAS, Rick Kumerfield has filed an appeal with the City Council as prescriLed by Section 19, Subdivision 2.2, and WHEREAS, the City Council has duly considered the facts and testimony pertinent to the said Appeal, NOW, THEREFORE, BE IT HEREBY RESOLVED BY THEi^CITY COUNCIL OF THE CITY OF PLYMOUTH that it should and does make the following findings: 1. That because of the particular physical surroundings of the specific parcel of land involved, a particular hardship to the owner would result, as distinguished from a mere inconvenience, if the strict letter of the regulations were to be carried out. 2. That the conditions upon which a petition for a variation is based are unique to the parcel of land for which the variance is sought and are not applicable, generally, to other property within the same zoning classification. 3. That the purpose of the variation is not based exclusively uponn-a desire to increase the value or income potential of the parcel of land. 4. That the alleged difficulty or hardship is caused by this Ordinance ani has not been created by any persons presently having an interest in the parcel of land. 5. That the granting of the variation will not be detrimental to the public welfare or injurious to other land or improvements in the neighborhood in which the parcel of land is located, and 6. That the proposed variation will not impair an adequate supply of light and air • Resolution No. 74-556 Page Two • • to adjacent pro-ierty, or substantially increase the congestion of the public streets, or '$nc ease the dange^of fire, or endanger the public safety, or substantially d minish or impair property values within the neighborhood. AND FURTHER, that based on these findings, the action of the Board of Zoning Adjust- ment dated October 8, 1914 should be and hereby is set aside and the variance is granted as requested. The motion for the adoption of the foregoing resolution was duly seconded by Councilman Neils, and upon vote being taken thereon, the following voted in favor thereof: Mayor Hilde and Councilman Neils. The following voted against or abstained: Councilman Seibold voted against. Whereupon the resolution was declared duly passed and adopted.
