Pursuant to due call and notice thereof, a regular meel� n% of the City Council of the City of Plymouth, Minnesota, was he on t e day of October , 19 74 The following members were present: MMayor Hilde, Councilmen Hunt, Neils, Seibold and Spaeth he following members were absent: none Councilman Spaeth introduced the following Resolution and moved is a option: RESOLUTION Nr. 74-508 A RESOLUTION WAIVING THE REQUIREMENT OF SECTION 462.358, SUBDIVISION 4, MINNESOTA STATUTES AND SECTION 9.02 OF CHAPTER VII OF THE CITY CODE RELATIVE TO CONVEYANCES BY METES AND BOUNDS OF PARCELS OF LAND CONTAINING LESS THAN FIVE ACRES - DONALD HENNINGS WHEREAS, Donald Hennings, who owns land in Section 30 of the City of Plymouth, has requested a subdivision variance, and WHEREAS, the City Planning Commission has reviewed said request and recommends approval, and WHEREAS, the City Council has now determined that the subdivision of said land into tti,- parcels, one of which would contain less than five (5) acres, would not interfere with the purposes of the Subdivision Regulations of the City of Plymouth and that a refusal to permit such subdivision would create an unnecessary hardship on such owner, NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH AS FOLLOWS: 1. Compliance with the provisions of Section 462.358, Subdivision 4, Minnesota Statutes, and Section 9.02 of Chapter VII of the City Code relating to convey- ances by metes and bounds of parcels of land containing an area of less than five (5) acres is hereby waived with response to the following described parcels: PARCEL A That part of the West 200 feet of Government Lot 4, Section 30, Township 118 North, Range 22 West of the Fifth Principal Meridian, lying South of the North 195 feet thereof and North of the Center Line of County Road No. 6 as now exists, Hennepin County, Minnesota. PARCEL B The West 220 feet of the North 195 feet of Government Lot 4, Section 30, Township 118, Range 22, and Resolution No. 74-508 • Page Two The East 20 feet of that part of the West 220 feet of Government lot 4. Section 30, Township 118, Range 22, lying South of the North 195 feet thereof and North of County Read Number 6. 2. The City Clerk is directed to prepare a certified copy of this resolution for recording purposes. The motion for the adoption of the foregoing resolbtion was duly seconded by Councii,,an Seibold, and upon vote being taken thereon, the following voted in favor thereof: Acting Mayor Hunt, Councilmen Neils, Seibold and Spaeth.
