RESOLUTION NO. 74-402
WAIVING THE REQUIREMENT OF SECTION 462.358, SUBDIVISION 4, MINNESOTA STATUTES
AND SECTION 9.02 OF CHAPTER VII OF THE CITY CODE RELATIVE TO CONVEYANCES BY METES AND
IOUNOS OF PARCELS OF LAND CONTAINING LESS THAN FIVE ACRES, PER REQUEST OF MURPHY OIL, CO.
WHEREAS, Murphy Oil Company has requested a subdivision waiver for Parcel 268, South
half of Section 22, Township 118, Range 22, Hennepin Cour;ty, and
WHEREAS, the City Planning Commission has reviewed said request and recommends
approval, and
WHEREAS, the City Council has now determined that the subdivision of said land into
two parcels, one of which would contain less than five (5) acres, would not interfere
with the purposes of the Subdivision Regulations of the City of Plymouth and that a
refuial to permit such subdivision would create an unnecessary hardship on such owner,
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH
AS FOLLOWS:
1. Compliance with the provisions of Section 462.358, Subdivision 4, Minnesota
Statutes, and Section 9.02 of Chapter VII of the City Code relating to conveyances
by metes and bounds of parcels of land containing an area of less than five (5)
arses is hereby waived with respect to the following described parcels:
PARCEL A
The East 140 feet of all that part of the following described tract
of land lying South of the South right-of-way of Trunk Highway number
55;
That part of the hereinafter described tract of land lying South of
the East and West center line of the North one-half of the Southwest
One -Quarter of Section 22, Township 118, Range 22, said tract of land
being described as follows: Commencing at the Southeast corner of
said Southwest Quarter of said section; thence West along the South
line of said Southwest One -Quarter 269.94 feet; thence North to a

point on the North line of the South One -Half of the Northwest
One Quarter of said Section, which point is 268.62 feet West of the
Northeast corner of .said South One-Helf of the Northwest One -Quarter;
thence East to the Northeast corner Of said South One -Half of the
Northwest.One-Quarter; thence South, to the point`of beginning.
All of the above subject to a roadway easement for Trunk Highway Number
_ 55 andi %onium Lanes. and a utility easement along the east side of the
above described property.
PARCEL B
Allthat part of the following. described land lying South of the
South right-of-w�rry line of Highway Number 55 and except the East
140 feet thew.
Commencing4 at the Southeast corner of the Southwest One -Quarter of
Section 22, Town'shfp 118, Range 22. Hennepin County, Minnesota,
thence West along the South line of said Southwest One -Quarter.
269.94 feet,' thence North to a point on the North line of the South
One -Half of the Northwest -One -Quarter of Section 22, which point is
268.62 feet West of the 'Northwest corner of said South One -Half of
Northwest One -Quarter, thence fast to the Northeast corner of said
South One -Half of Northwest One -Quarter, thence South to the point
of beginnino.
2. The City Clerk is directed to prepare a certified copy of this Resolution
for recording purposes.
The motion for the adoption of the foregoing Resolution was duly seconded by
Councilman Neils, and upon vote being taken thereon, the following voted in favor
thereof: Mayor HI do, Councilmen Seibold, Neils, and Spaeth. The following
voted against or abstained; Councilman Hunt. Whereupon the Resolution was
declared duly passed and adopted.
