HomeMy WebLinkAboutCity Council Resolution 2020-141 C ITY OF P LYMOUTH R ESOLUTION N O. 2020-141 R ESOLUTION A PPROVING A PUD A MENDMENT FOR A CCESS D EVELOPMENT, LLC FOR AN A PARTMENT B UILDING AT 11229 H IGHWAY 55 (2019 099) WHEREAS, Access Development, LLC, has requested approval of a PUD amendment to allow construction of a 61-unit, four-story apartment building on property legally described as Lot 1, Block 1, Crossroads Commons Second Addition, Hennepin County, Minnesota; and WHEREAS, the Planning Commission has reviewed said request at a duly called public hearing. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and does approve the request by Access Development, LLC, for a PUD amendment for a new apartment building, subject to the following conditions: 1. A PUD amendment is approved to allow construction of a 61-unit, four-story apartment building, in accordance with the plans received by the city on February 10, 2020, except as may be amended by this resolution. 2. A separate building permit is required prior to commencement of the project. 3. Prior to issuance of the building permit, the applicant shall fulfill the requirements, submit the required information, and revise the plans as indicated below, consistent with the applicable city code, zoning ordinance, and engineering guidelines: a. Submit and obtain city approval of a PUD final plan application. The PUD final plan application must include/address the following: 1. a final building design (architecture, materials, and colors) that provides a unified, cohesive development; 2. access to, and short-term outside storage of dumpsters on garbage pick-up day, to ensure that dumpsters do not block drive aisles or parking spaces; 3. a snow removal plan; and 4. a revised lighting plan that complies with the maximum lighting intensity allowed based on lumens per square foot, and that complies with the BUG (backlight, uplight, and glare) rating for the fixtures. b. Provide final construction drawings for staff approval. c. Demonstrate compliance with all city and watershed regulations pertaining to water quality/rate control, and obtain any required review/approval from the watershed district. d. Obtain an encroachment agreement for retaining wall and parking lot area to be located within a drainage/utility easement. e. Obtain and provide the required stormwater maintenance agreement. Resolution 2020-141 File 2019099 Page 2 f. Provide additional drainage and utility easement to cover the existing underground vault storm system. This easement must extend a minimum of ten feet beyond the boundaries of the underground vault storm system. g. Assess the noise impacts from Highway 55, and incorporate whatever noise mitigation measures are necessary (e.g., extra wall insulation, ridge vents, triple-pane windows, etc.) to ensure compliance with state noise standards. h. Pay the required park dedication fee. i. Complete a site improvement performance agreement and submit the related financial guarantees pursuant to section 21045.10 of the zoning ordinance. 4. Silt fence shall be installed prior to any construction on the site. 5. With respect to the existing storm water vault located in the northwest portion of the lot, note the following: a. No trees shall be planted atop the storm water vault. b. Equipment used to grade atop the storm water vault shall have tracks to minimize damage to the vault. c. Limit deliveries or storage of materials atop the storm water vault during construction. d. Delineate and protect the storm water vault with tree fencing or snow fencing during construction. e. Televise the storm water vault chamber before and after the project to ensure the system is not damaged or filled with sediment. 6. One free-standing monument sign that complies with the apartment signage regulations is allowed in the front yard area of the site upon prior approval of a separate sign permit. No wall signage is allowed on the apartment building. 7. Fire Division comments: a. Add a hydrant within 50 feet of the fire department connection. The hydrant must be located between the two westernmost handicap parking spaces. b. Relocate the west hydrant to the parking lot island 70 feet to the west. c. A solenoid valve is required on the water supply line to the building. d. The entire building shall be protected by a city-approved fire sprinkler system, and a city-approved fire alarm system is required. e. Submit fire flow calculations prior to permit issuance of the water and sewer permit. f. Fire lane signs are required in locations to be determined by the Fire Inspector. g. A fire department lock box is required in a location approved by the Fire Inspector. 8. Standard Conditions: a. The project must comply with all building code requirements. b. Any damage to the sidewalk shall be repaired. c. Any rooftop or ground-mounted mechanical equipment shall be painted or screened to match the building. d. The applicant shall remove any diseased or hazardous trees. Resolution 2020-141 File 2019099 Page 3 e. No trees may be planted in the public right-of-way. f. Any subsequent phases or expansions are subject to required reviews and approvals per ordinance provisions. APPROVED by the City Council on this 14th day of April, 2020.
