HomeMy WebLinkAboutCity Council Resolution 2020-140 C ITY OF P LYMOUTH R ESOLUTION N O. 2020-140 R ESOLUTION D ENYING A P ETITION R EQUESTING P REPARATION OF AN E NVIRONMENTAL A SSESSMENT W ORKSHEET (EAW) FOR A P ROPOSED A PARTMENT B UILDING TO BE CALLED “T HE E LEMENT” WITHIN THE C ROSSROADS C OMMONS PUD (2020023) WHEREAS, Access Development, LLC has requested approval of a PUD amendment to allow a 61-unit, four-story apartment building on the vacant development site located at 11229 State Highway 55; and WHEREAS, the Minnesota Environmental Quality Board (EQB) received a citizens petition for an environmental assessment worksheet (EAW) for the proposed apartment building project; and WHEREAS, the petition for the EAW included three primary concerns including wetland setback, development within a floodplain, and groundwater contamination/parking lot runoff; and WHEREAS, the Minnesota Environmental Review Program Rules provide for the mandatory preparation of an EAW for those projects that meet or exceed the thresholds contained in the Section 4410.4300 of the Rules; and WHEREAS, neither The Element apartment building project nor the cumulative development proposed within the Crossroads Commons PUD requires the mandatory preparation of an EAW; and WHEREAS, the Minnesota Environmental Review Program Rules provide for the discretionary preparation of an EAW for those projects where the City Council, acting as the responsible governmental unit (RGU), finds that because of the nature or location of the proposed project, the project may have the potential for significant environmental effects. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it determines that a discretionary EAW shall not be required for The Element apartment building project (city file 2019099), based on the following findings: a) The petition fails to demonstrate that, because of the nature or location of the proposed project, the project may have the potential for significant environmental effects. b) The project proposer has either addressed all environmental concerns indicated in the EAW petition, or the city would address them through code requirements and conditions if the project is ultimately approved, therefore, the project would not result in significant environmental effects.
