R ESOLUTION N O. 2020-137
R ESOLUTION A PPROVING T ERMINATION OF T WO D ECLARATIONS
FOR P ROPERTY LOCATED AT 2100 F ERNBROOK L ANE (92030)
WHEREAS, the owner of 2100 Fernbrook Lane is requesting the termination and release of a
1992 declaration of covenants and restrictions relating to a certificate of occupancy, which was recorded
at Hennepin County as Document No. 5956076; and
WHEREAS, the above-reference certificate of occupancy was issued by the city in 1993; and
WHEREAS, the owner of 2100 Fernbrook Lane is requesting the termination and release of a
1992 declaration relating to a variation from City of Plymouth zoning ordinance (parking) requirements,
which was recorded at Hennepin County as Document No. 5932113; and
WHEREAS, the above-referenced variation from City of Plymouth zoning ordinance (parking)
requirements was not needed, and the site presently has 71 more parking spaces than required by city
code; and
WHEREAS, the city finds that the two above-referenced declarations are no longer required; and
WHEREAS, the subject property is legally described as Lot 1, Block 1, Volp 2nd Addition,
Hennepin County, Minnesota.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH,
MINNESOTA, that it should and does terminate and release the two declarations mentioned herein.
Furthermore, the Mayor and City Manager are authorized to sign the two associated termination and
release documents.
