R ESOLUTION N O. 2020-135
R ESOLUTION A PPROVING F INAL P AYMENTS FOR THE C ANADIAN P ACIFIC R AILROAD
Q UIET Z ONE P ROJECT (ST080006)
WHEREAS, the City of Plymouth and Soo Line Railroad Company, doing business as Canadian
Pacific, entered into two agreements for the City Project ST080006. Said agreements were approved by
the City Council on November 28, 2017 (Resolution 2017-348); and
WHEREAS, the Engineer has certified his acceptance of the work and approval of the final
request for payment.
NOW, THEREFORE BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH,
MINNESOTA:
1. That the original agreements estimated a construction cost borne by CP Rail and billable to the
City of Plymouth in an amount of $477,419.19. The actual costs amount to $425,422.27, which
is below the original estimate.
2. That the work performed by the contractor for the Quiet Zone project is complete and certified
to the Council by the engineer as acceptable, being the same, is released from the contract
except as to the conditions of the performance bond, any and all legal rights of the owner,
required guarantees, submittal of signed IC-134s for compliance, and correction of faulty work
after final payment.
3. Request for final payments in the amount of $74,471.89 for CP#126993 and $19,366.09 for
CP#126994 to Canadian Pacific, Inc. for the Quiet Zone project is approved and the Finance
Manager is authorized and directed to pay the same forthwith.
4. The total project cost is $467,964.50 which includes all costs paid to Canadian Pacific Rail of
$425,422.27, and design, administration, and contingency in the amount of $42,542.23.
BE IT FURTHER RESOLVED that the funding for this project shall come from the Street
Reconstruction Fund in the amount of $467,964.50.
