The following members were present: Mayer were Councilman Hunt introduced the following Resolution anr. moved its adoption: RESOLUTION 74-352 VACATING A PORTION OF BERKSHIRE LANE NORTH. AT THE REQUEST OF VANTAGE COMPANIES, INC, WHEREAS, Vantage Companies, Inc., owner of that part of Lot 1, Block 1, Minneapolis Industrial Park 2nd Addition ?yang west of the Westerly right-of-way line of Annapolis Lane, has requested approval of the vacation of that part of Berkshire Lane (formerly known as Peripheral Road) which lies north of the North right-of-way line of 24th Avenue North; and WHEREAS, notice of a public hearing on the question of said vacation was duly and properly given, and said hearing was held at a regular meeting of the City Council of the City of Plymouth on August 5, 1974; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH that that part of Berkshire Lane which lies north of the North right-of-way line of 24th Avenue North be vacated, subject. however, to the following conditions: 1. This vacation shall not affect the right. power and authority of the City of Plymouth to own, control, maintain, repair, replace, remove or otherwise attend to the sanitary sewer and water lines which presently lie within that portion of Berkshire Lane vacated by this Resolution. 2. The City of Plymout!� retains the right to own, construct, control. maintain, repair. replace, r�xriove or otherwise attend to any other public utility uses it may in the future wish to make of that portion of Berkshire Lane vacated by this Resolution. The motion for the adoption of the foregoing Resolution was duly seconded by a?id upon vote being taken thereon, the 0 owing vote n avor thereof: IR—ay'or Hilde.
