HomeMy WebLinkAboutCity Council Resolution 1974-269CITY OF PLYMOUTH Pursuant to due call and notice thereof, a regular meeting of the City CounSil of the City of PlynNth, Minnesota, was held on t� 3rd day of 9 . 1The following members were present: mayor Hitt%j COUncil n Hunts Neil`s; Seibold and Spaeth The following members were absent: Councilman Neils introduced the following Resolution and mved its adoption: RESOLUTION NO. 74-269 APPROVING FINAL PLAT AND DEVELOPMENT CONTRACT - "CHELSEA WOODS CONDOMINIUMS 3RD ADDITION" WHEREAS, BanCon, tncw has requested Final Plat and DeveioOrnent Contract approval for Chelsea Woods Condominiums Third Addition for properti—located north of 18th Avenue within the Chelsea Woods Development, NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH that Final Plat (Exhibit A) and Development Contract (Exhibit B) for "Chelsea Woods Condominiums Third Addition" be approved and the Mayor and the City Manager be author- ized to sign the Development Contract for ;his project. TO SUBDIVISION DEVELOPI%MKT CONTRACT FOR CHELSEA WOODS IST ADDITION June 3, 1974 Resolution 74-269 CONTRACT NO. A-320 WHEREAS, the City of Plymouth, hereinafter called the City, and.Ban-Con, Inc., :,ereinafter called the Developer, have entered into a Subdivision Development C,ntract, dated October 4, 1971, for the development and improvement of Chelsea Woods 1st Addition,. hereinafter called the Development Contract, and IVHEREAS, it was the intent of both parties hereto that the Subdivision Development Contract for Chelsea hoods 1st Addition would cover the entire preliminary plat as indicated in Paragraphs 19-A and 19-B of said Contract, and WHEREAS, the Developer now wishes to develop and improve Chelsea Woods Condominiums Third Addition, substantially in accordance with approved preliminary plat. NOW, THEREFORL, BE IT RESOLVED and mutually agreed as follows: 1. General Reference All provisions, conditions and requirements of the Development Contract shall apply to and be binding on Chelsea Woods Condominiums' Third Addition. 2. Contract is hereby amended to add and include the following language: The developer and the City both recognize and agree that certain connection charges for building permits issued in conjunction with. this development have not been collected. These charges total $210000 The developer and the City further understand and agree that water area charges for 82units for which permits were issued after May 15, 1973 to June 3, 1974 have not been paid. These water area charges due amount to $18,450. The developer and the City understand and agree that the developer is due credit for lateral assessments previously assessed to the property as part of the Southwest sewer and water project in the amount of $6,270. In order to resolve these outstanding obligations, the developer and the City agree as follows: i (1) (2) (3) (4) v That of the total adjusted obligation to the City amounting to $34,080 ($40,350 less $6,270), the developer shall pay to the City $11,350 with the execution of this contract. That the balance totalling $22,720 shall be paid as a surcharge on additional building permits to be requested by the developer as follows a. Chelsea Woods Condominiums 3rd Addition $200 per dwelling unit with 34 building permits issued. $ B,4a b. Other phases of development $181.33 per dwelling unit with next _ 90 -building permits issu,;d. $16,32 It is agreed and understood that should any of the aforementioned charges not be totally paid through the payment of the surcharge with the building permits prior to December 31, 1976, the full amount then outstanding shall become due and payable in total. It is agreed and understood that the developer shall be required to pay- water aywater area charges in the amount of $225 per dwelling unit for all future dwelling units in the Chelsea Woods development prior to the issuance of building permits: compaction or street enc site improvements. he shall Furnish a certificate.` of deposit in the amoemi of Sixty Ont Thousand Four Hundred Ninety Three Dollars ($61,493.00) or -a surety performance bond in the amount of Ninety Two Thousand T-Ym :ijndree Thirty Nine Dollars ($92,239.00) in acc:rdance with Para 9 aph. 9 rf the Development Contract.
