The following me.aters were present: Mayor Hi e, ounc men unt, 11e-iTs and Spa eth The following members were absent: Councilman Seibold x** Councilman Spaeth introduced the following Resolution and moved s adoption: RESOLUTION NO. 74-241 WAIVING THE REQUIREMENT OF SECTION 462.358 SUBDIVISION 4, MINNESOTA STATUTES AND SECTION 9.02 OF CHAPTER VII OF THE CITY CODE RELATIVE TO CONVEYANCES BY METES AND BOUNDS OF PARCELS OF LAND CONTAINING LESS THAN FIVE ACRES WHEREAS, Joseph J. Eberle, who owns land in Section 36 of the City of Plymouth, has requested a subdivision variance, and WHEREAS, the City Planning Commission has reviewed said request and recommends approval, and WHEREAS, the City Council has noir determined that the subdivision of said land into two parcels, one of which would contain less than five (5) acres, would not interfere with the purposes of the Subdivision Regulations of the City of Plymouth and that a refusal to permit such subdivision would create an unnecessary hardship on such owner. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, AS FOLLOWS: 1. Compliance with the provisions of Section 462.358, Subdivision 4, Minnesota Statutes, and Section 9.02 of Chapter VII of the City Code relating to conveyances by metes and bounds of parcels of land containing an area of less than five (5) acres is hereby waived with respect to the following described parcels: PARCEL A The north 108 feet of the west 241 feet of the Southwest Quarter of the Southwest Quarter of Section 36, Township 118, Range 22. Subject to road easement over the wes' 33 feet thereof. PARCEL B The south 105 feet of the north 318 feet of the west 241 feet of the Southwest Quarter of the Southwest Quarter of Section 36. Township 118, Range 22, subject to road easement over the west 33 feet thereof. 2. The City Clerk is directed to prepare a certified copy of this Resolution for recording purposes. Page Two The motion for the adoption of the foregoing Resolution was duly seconded by Councilman Hunt, and upon vote being taken thereon, the following voted in favor thereof: Mayor Hilde Councilmen Hunt, Neils and Spaeth. The following voted against or abstained: none. Whereupon the Resolution was declared duly passed and adopted.
