RESOLUTION NO. 74-218
A RESOLUTION WAIVING THE REQUIREMENT OF SECTION 462.358 SUBDIVISION 4.
MINNESOTA STATUTES AND SECTION 9.02 OF CHAPTER VII OF THE CITY CODE
RELATIVE TO CONVEYANCES BY METES AND BOUNDS OF
PARCELS OF LAND CONTAINING LESS THAN 5 ACRES
WHEREAS, Alfred J. Eberle, who owns land in Sections 35 and 36 of the City of
Plymouth, has requested a subdivision variance, and
WHEREAS, the City Planning Commission has reviewed said request and recommends
approval, and
WHEREAS, the City Council has now determined that the subdivision of said land into
two parcels, one of which would contain less than five (5) acres, would not interfere
with the purposes of the Subdivision Regulations of the City of Plymouth and that a
refusal to permit such subdivision would create an unnecessary hardship on such owner,
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH,
AS FOLLOWS:
1. Compliance with the provisions of Section 462.358, Subdivision 4. Minnesota
Statutes. and Section 9.02 of Chapter VII of the City Code relating to conveyances
by metes and bounds of parcels of land containing an area of less than five (5)
acres is hereby waived with respect to the following described parcels:
PARCEL A
The north 109.33 feet of the west 203 feet of the South Third
of the Northwest Quarter of the Southwest Quarter of Section 36,
Township 118, Range 22. Subject to road easement over the rest
33 feet thereof. Area - 18,580 square feet + (Excluding road ease-
ment). -10
PARCEL B
The North Half of the South Third of the Northwest Quarter of
the Southwest Quarter of Section 36, Township 118, Range 22,
except the north 109.33 feet of the west 203 feet thereof, subject

to road easement over the most westerly 33 feet thereof.
Area - 263,340 square feet + (excluding road easement).
2, The City Clerk is directed to prepare a certified copy of this Resolution
for recording purposes.
The motion for the adoption of the foregoing Resolution was duly seconded by
Councilman Hunt, and upon vote being taken thereon, the following voted in favor
thereof: Mayor Hilde, Councilmen Hunt, Neils. Seibold and Spaeth. The following
voted against or abstained: none. Whereupon the Resolution was declared duly passed
and adopted.
