Minnesota, washel d on 15th day of April , 19 74 The follo-ging members were present: Mayor e,ounc men eils,_ eibold and Spaeth _ The following members were abs nt: ounc man Hunt _ Councilman Neils introduced the following Resolution and moved s adoption: RESOLUTION NO. 74-200 BOND REDUCTION - PONDEROSA ADDITION WHEIEAS, Wayzata Developers, as developer, have platted Ponderosa Addition and therein dedicated certain streets, and pursuant to certain provisions of City Ordinances and Development Contract No. A-253 dated August 12, 1971, have undertaken to construct certain utilities within said plat as follows: Sanitary Sewer and Water Main . Fountain Lane - 25th Avenue to Garland Lane Garland Lane - 25th Avenue to Fountain Lane Everest Lane - Fountain Lane to north plat line 25th Ave.* - West plat line to Dunkirk Lane 27th Avenue cul-de-sac - at Fountain Lane Garland Lane cul-de-sac - at 25th Avenue *Sanitary sewer only Storm Sewer Garland Lane cul-de-sac south of 25th Avenue 25th Avenue North west from Fountain Lane Fountain Lane and Garland Lane WHEREAS, said Development Contract provides for the City of Plymouth to pay $16,618.:^ to the Developer for the cost of additional length. depth and size of sanitary sewer required in order to serve adjacent property, and WHEREAS, Wayzata Developers, as developer, have requested that approval and final acceptance of said sanitary sewer, water main and storm sewer by the City of Plymouth, be given, and WHEREAS, the City Engineer has examined and inspected said utilities and certifies that they were constructed in accordance with all City requirements and recommends acceptance of same by the City, and No. 74-200 • • ►D6-.n PT . WHEREAS, in accordance with the Development Contract No. A-253 dated August 12, 1971 the Developer and the surety on his bond will continue to be responsible for any defects in the work, latent or otherwise, for a period of one year from and after the date of acceptance by the City. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, that the sanitary sewer, water main and storm sewer construction heretofore described and covered under a bond from Transamerica Insurance Company No. 5361-21-89 in the amount of $180,000 is hereby reduced to $0.00 and the City Manager be authorized to pay the developer, Wayzata Developers, the amount of $16,618.50. The motion for the adoption of the foregoing Resolution was duly seconded by Councilman Seibold, and upon vote being taken thereon, the following voted in favor thereof: Mayor Hilde, Councilmen Neils, Seibold and Spaeth. The following voted against or abstained: none. Whereupon the Resolution was declared duly passed and adopted.
