CITY OF PLYMOUTH
Pursuant to due call and notice thereof, a regular meeting of the City
Council of the City of Plymouth, t'-*.nnesota, was held on the 1st day of
April , 19 74 . The following members were present: Mayor
de , ounc men unt, Neils. Seibold and Spaeth _
The following members were absent: none
Councilman Spaeth introduced the following Pesolution and moved
s adoption:
RESOLUTION NO. 74-180
RELEASE OF OBLIGATIONS - MAPLEDELL PLAT
WHEREAS, the City of Plymouth -(then Village of Plymouth) did, on the 31st
day of May, 1967, enter into an Agreemdnt with J & G Construction Corporation,
Inc., a Minnesota Corporation, Countryside Development Corporation, a Minnesota
Corporation, Fred Buchinger and Ida Buchinger, husband and wife, and Willis
W. Snyder and Lucille Snyder, husband and wife and,
WHEREAS, said Agreement provided that each of the lots within Mapledell
Addition would be subject to assessments for improvements to be made to Dunkirk
Lane, such assessments to be made without the necessity of formal assessment
proceedings as required by Chapter 429, Minnesota Statutes .and,
WHEREAS, said Agreement was filed for record in the office of the Register
of Deeds of Hennepin County, Minnesota on June 16, 1967 in Book 2590 of Miscel-
laneous Records, Page 415 as document number 3660100 and
WHEREAS, said improvements to Dunkirk Lane have been made and assessments
therefore have been duly levied by Levy 4173 confirmed on October 4, 1967
by Resolution No. 67-172,
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PLYMOUTH, MINNESOTA, AS FOLLOWS:
1. All the improvements to Dunkirk Lane contemplated by the aforementioned
Agreement having beep made and all assessments for said improvements
having been levied, all of the lots in Mapledell Addition are hereby
released and discharged from all obligations arising out of that certain
Agreement between the City of Plymouth (then Village of Plymouth) and
J & G Construction Corporation, Inc., Countryside Develop::nt Corporation,
Fred Buchinger and Ida Buchinger, husband and wife, and Willis W.
Snyder and Lucille Snyder, husband and wife, which Agreement was dated
May 31, 1967.
2. The City Clerk is hereby directed to file with the Register of Deeds
of Hennepin County, Minnesota, a`certified copy of this resolution.

' The motion for the adoption of the foregoing Resolution was duly seconded
by Councilman Neils, and upon vote being taken thereon, the following voted
in favor thereof: Mayor Hilde, Councilmen Hunt, Neils, Seibold and Spaeth.
The following voted against or abstained: none. Whereupon the Resolution was
declared duly passed and adopted.
