HomeMy WebLinkAboutCity Council Resolution 1974-067Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of Plymouth, Minnesota, was held on the 4th day of February, 1974. The following members were present: Mayor Hilde, Councilmen Neils, Seibold and Hunt. The following members were absent: Councilman Spaeth. Councilman Neils introduced the following Resolution and moved its adoption: RESOLUTION NO. 74-67 RAILROAD CROSSING LICENSE WHEREAS, Carlson Companies, Inc., a Minnesota corporation, for itself and Litton Systems, Inc., a Delaware corporation, has re- quested the granting of a license for rail access across certain ' street right-of-way, and WHEREAS, a License Agreement has been prepared and the Manager recommends the granting of said license, NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH that the Mayor and Manager are hereby authorized and directed to execute on behalf of the City of Plymouth a License for a period of fifty years for the construction and maintenance of spur tracks across City right-of-way as described in said agreement. 'The motion for the adoption of the foregoing Resolution was duly seconded by Councilman Seibold, and upon vote being taken thereon, the following voted in favor thereof: Mayor Hilde, Councilmen Neils, Seibold and Hunt. The following voted against or abstained: None. Whereupon the Resolution was declared duly passed and adopted. Corporation, and to Litton Systems, Inc., a Delaware Corporation, a license for a period of fifty (50) years from the date hereof for the construction and maintenance of spur tracks across the City Street which is legally described as follows: The South 33 feet of the East half of the Southeast quarter of the Southwest quarter of Section 27, Township 118, Range 22, except railroad and The North 33 feet of that part of the Northeast quarter of the Northwest quarter of Section 34, Township 118, Range 22, lying Easterly of the Southerly extension of the Fasterly line of Lot 21, Parker Lake Gardens, according to the recorded plat thereof and Northerly of the Northerly right-of-way line of the Electric Short Line Railroad. Willis to me personally known, who, being by me duly sworn did say that they are respectively the Mayor and City Manager of the City of Plymouth, the City named in the foregoing instrument, and that said instrument was signed in behalf of the City of Plymouth by authority of its City Council and said Al Hilde, Jr. and James G. Willis acknowledged said instrument to be the fee act and deed of the City of Plymouth.
