Pursuant to due call and notice thereof, a regular meeting of the City Council
of the City of Plymouth, Minnesota, was held on the 21st day of January, 1974. The
following members were present: Acting Mayor Hunt, Councilmen Neils, Seibold and
Spaeth. The following members were absent:
Councilman Seibold introduced the following Resolution and moved its edoption:
RESOLUTION NO. 74-48
A RESOLUTION WAIVING THE REQUIREMENT OF SECTION
462.358, SUBDIVISION 4, MINNESOTA STATUTES AND
SECTION 9.02 OF CHAPTER VII OF THE CITY CODE
RELATIVE TO CONVEYANCES BY METES AND BOUNDS OF
PARCELS OF LAND CONTAINING LESS THAN FIVE ACRES
WHFRF!,S, Harlan P. Peterson who owns land in Section 1 of the City of
Plymouth, has requested a Subdivision Variance, and
WHEREAS, the City Planning Cominission has reviewed said request and
recommends approval, and
WHEREAS, the City Council has now determined that the subdivision of
said land into two parcels, one of which would contain less than five (5)
acres, would not interfere with the purposes of the Subdivision Regulations
of the City of Plymouth and that a refusal to permit such subdivision
would create an unnecessary hardship on such owner,
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY
OF PLYMOUTH AS FOLLOWS:
1. Compliance with the provisions of Section 462.358, Subdivision
4, Minnesota Statutes, and Section 9.02 of Chapter VII of the
City Code relating to conveyances by metes and bounds of par-
cels of land containing an area of less than five (5) acres is
hereby waived with respect to the following described parcels:
PARCEL A
Commencing on South line of NE 1/4 distant 900 feet East
from the SW corner thereof thence North 0 degrees 15
minutes East a distance 600 feet thence East parallel
with the South line of Section 1 a distance 660 feet thence
South to the center line of County Road 10; thence South-
westerly along said center line to its intersection with
the said south line of said NE quarter; thence Westerly
along the said south line to the point of beginning, except
road, all in !section 1, Township 118, Range 22, Hennepin
County, Minnesota.

. Commencing at the SW corner of the NE 1/4 thence East
900 feet thence deflecting left 89 degrees 45 minutes on
a distance 600 feet thence East parallel with South line
of NE 1/4 a distance 660 feet thence South to center line
of County Road 10 thence East along said center line to a
point 20 rods West from the East line of Section 2 thence
North parallel to east line to a point 56 rods South from
the North line of Section 1 thence East parallel with the
South line of said KE' 1/4 to the East line thereof thence
North to the NE corner of the NE 1/4 thence West to the NW
corner of NE 1/4 of NE 1/4 thence South along the West line
of NE 1/4 of NE 1/4 a distance of 20 rods thence West paral-
lel with the North line of the NE 1/4 to West line thereof
thence South to beginning, except roads all in Section 2,
Township 118, Range 22, Hennepin County, Minnesota.
2. The City Clerk is directed to prepare a certified copy of this
Resolution for recording purposes.
The motion for the adoption of the foregoing Resolution was duly seconded by
Councilman Neils, and upon vote being taken thereon, the following voted in favor
thereof: Acting Mayor Hunt, Councilmen Neils, Seibold and Spaeth. The following
voted against or abstained: None. Whereupon the Resolution was declared duly passed
and adopted.
