HomeMy WebLinkAboutCity Council Resolution 1974-044CITY OF PLYMOUTH Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of Plymouth, Minnesota, was held on the 21st day of January, 1974. The following members were present: Acting Mayor Hunt, Councilmen Neils, Seibold and Spaeth. The following members were absent: Mayor Hilde. Councilman Seibold introduced the following Resolution and moved its adoption: RESOLUTION NO. 74-44 IMPERIAL HILLS STH ADDITION BOND REDUCTION WHEREAS, Ecklund-Swedlund Development Corporation, as Developer, have platted Imperial Hills 5thAddition and therein dedicated certain streets, and pursuant to certain provisions of the City Ordinances and Development Contract No. A-178 dated September S. 1972, have undertaken to construct certain utilities within said plat as follows: Streets, Sanitary Sewer, Water Main and Storm Sewer Facilities 24th Avenue North - from Troy Lane to 23rd Avenue North. 23rd Avenue North - from 24th Avenue to cul-de-sac. Shadyview Lane - from 23rd Avenue to Queensland Lane WHEREAS, Ecklund-Swedlund Development Corporation, as Developer, have filed and also, made their request for approval and the final acceptance of said streets, sanitary sewer, water main and storm sewer by the City of Plymouth, and WHEREAS, the City Engineer has examined and inspected said streets and utilities and certifies that they were constructed in accordance with all City requirements and recommends acceptance of same by the City, and WHEREAS, in accordance with the Development Contract No. A-178 dated September 8, 1972, the Developer and the surety on his bond will continue to be responsible for any defects in the work, latent or otherwise, for a period of one year from and after the date of acceptance by the City. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, that the streets, sanitary sewer, water main and storm sewer heretofore described for the Imperial Hills 5th Addition, be and are hereby accepted by the City of Plymouth as City streets and utilities and the Developer and the surety on his bond will continue to be responsible for any defects in the work latent or otherwise, for a period of one year from and after the date of this Resolution as provided for in the Development Contract No. A-178 dated September 8, 1972.
