HomeMy WebLinkAboutCity Council Resolution 1973-424VILLAGE OF PLYMOUTH Pursuant to due call and noti=z thereof, a regular meeting of the Village Council of the Village of Plymouth, Minnesota, was held on the 15th day of October, 1973. The following members were present: Acting Mayor Hunt, Councilmen Neils, Seibold and Spaeth. The following members were absent: Mayor Hilde. Councilman Spaeth introduced the following Resolution and moved its adoption: RESOLUTION NO. 73-424 WHEREAS, Lundgren Brothers Construction, Inc., as Developer, have platted Wood Creek Addition and therein dedicated certain streets, and pursuant to certain provisions of Village Ordinances and Development Contract No. A-305 dated May 7, 1973, have undertaken to construct certain utili,.;es within said plat as follows: Sanitary Sewer, Water Main and Storm Sewer Facilities 1. 34th Avenue North from East Medicine Lake Road to Saratoga Lane. 2. Wellington Lane south of 34th Avenue North. 3. 33rd Avenue North west from Saratoga Lane. 4. Saratoga Lane south from 34th Avenue North. 5. All easements as shown on plans. WHEREAS, Lundgren Brothers Construction, Inc., as Developer, have filed and also made their request for approval and fina' acceptance of said sanitary sewer, water main, and storm sewer by the Village of Plymouth, and WHEREAS, the Village Engineer has examined and inspected said utilities and certified that they were constructed in accordance with all Village requirements and recommends acceptance of same by the Village, and WHEREAS, in accordance with the Development Contract No. A-305 dated May 7, 1973, the Developer and the surety on his bond will continue to be responsible for any defects in the work, latent or otherwise, for a period of one year from and after the date of acceptance by the Village. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE VILLAGE COUNCIL OF THE VILLAGE OF PLYMOUTH that the sanitary sewer, water main and storm sewer heretofore described for the Wood Creek Addition, be and are hereby accepted by the Village of Plymouth as Village utilities and the Developer and the surety on his bond will continue to be responsible for any defects in the work, latent or otherwise, for a period of one year from and after the date of this Resolution as provided for in the Development Contract No. A-305 dated May 7, 1973. The motion for the adoption of the foregoing Resolution was duly seconded by Councilman Seibold, and upon vote being taken thereon, the following voted in favor thereof: Acting Mayor Hunt, Councilmen Neils, Seibold and Spaeth. VILLAGE OF PLYMOUTH I, the undersigned, being the duly qualified and acting Clerk of the Village of Plymouth, Minnesota, hereby certify that I have carefully compared the foregoing extract of the minutes of a regular meeting of the Village Council of said Village held on October 15, 1973, with the original thereof on file in my office, and the same is a full, true and complete transcript therefrom.
