HomeMy WebLinkAboutCity Council Resolution 1973-397v VILLAGE OF PLYMOUTH Pursuant to due call and notice thereof, a special meeting of the Village Council of the Village of Plymouth, Minnesota, was held on the 9th day of October, 1973. The following members were present: Mayor Hilde, Councilmen Hunt, Spaeth, Neils and Seibold. The following members were absent: None. Councilman Neils introduced the following Resolution and moved its adoption: RESOLUTION NO. 73-397 RESOLUTION ADOPTING ASSESSMENT FOX MEADOWS FIRST ADDITION SANITARY SEWER $ WATER AREA CHARGES � W;iEREAS, Pursuant to proper notice duly given as required by law, the Council has met and heard and passed upon all objections to the proposed assessment for the improvement of Lots 1 through 8, Block 1 and Lots 1 through 6, Blocf 2, Fox Meadows First Addition for previously constructed sanitary j sewer trunk, forcemain, lift staion, and interceptor charges, and water trunk I main, pumping and storage facilities, and has amended such proposed assessment as it deems just. NOW, THEREFORE, BE IT RESOLVED BY THE VILLAGE COUNCIL OF THE VILLAGE OF ' PLYMOUTH, MINNESOTA: 1. Such proposed assessment, an amended copy of which is attached hereto and made a part hereof, is hereby accepted and shall constitute the special assessment against the lands named therein and each tract of land therein included is hereby found to be benefited by the proposed improvement in the amount of the assessment levied against it. j2. Such assessment Shall be payable in equal annual installments extending j over a period of 15 years, the first of the installments to be payable on or before the first Monday in January, 1974, and shall bear interest at the rate of 8% per annum from the date of the adoption of this assessment resolution.To the first installment shall be added interest on the entire assessment from the date of this resolution until December 31, 1973. To each subsequent installment when due shall be added interest for one year on all unpaid installments. 3. The owner of any property so assessed may, at any time prior to certi- fication of the assessment to the County Finance Director, pay the whole of the assessment on such property, with interest accrued to the date of payment to the Village treasurer, except that no interest shall be charged if the entire assessment is paid within 30 days from the adoption of this resolution; and he may, at any time thereafter, pay to the County Treasurer the entire amount of the assessment remaining unpaid, with interest accrued to December 31 of the year in which such payMOnt is made. 4. The Clark shall forthwith transmit a certified duplicate of this assessment to the County Finance Director to be extended on the proper tax lists of the County, and such assessments shall be collected and Paid over in the same manner as other municipal taxes. '*97 j Page Two The motion for the adoption of the foregoing Resolution was duly seconded by Councilman Seibo1q , and upon vote being taken thereon, the following voted in favor thereof: Mayor Hilde, Councilmen Hunt, Neils, Spaeth and Seibold. The following voted against or abstained: None. Whereupon the Resolution was delcared duly passed and adopted. STATE OF MINNESOTA ) COUNTY OF HENNEPIN )SS. VILLAGE OF PLYMOUTH ) I, the undersigned, being the duly qualified Acting Clerk of the Village of Plymouth, Minnesota, hereby certify that I have carefully compared the foregoing extract of the minutes of a special meeting of the Village Council of said Village held on October 9, 1973, with the original thereof on file in my office, and the same is a full, true and complete transcript therefrom.
