WHEREAS, Mr. Don Russ, owner -of the Fox Meadows apartment has requested
an amendment to the development contract for the Fox Meadows First Addition
dated August 10, 1970, and
WHEREAS, the Village Council has considered this request, -
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE VILLAGE COUNCIL OF THE ±,
VILLAGE Of PLYMOUTH that the development contract for the Fox Meadows'First
Addition (A-230) dated August -10, 1970 is amended as follows;
SPECIAL CONDITIONS, Paragraph 16, page B -- It shall ba`unders,tood,
that the language of this paragraph shall,be interpreted bythe
parties to this contract to allow the seedingg of,'the Major •portioos.: -_ •
of the -berm constructed along the westeriy�sit
provided :that the Village Engineer specifies
sodding shall be required due to grading or e

s FURTHER understood- that the seeding_of ithe
be undertaken in such a fashion as to assure i
appropriately seeded by the spring of 1974 in
generallY;-accepted seeding practices used -for
The daveloper agrees to�sod the berm in quest
efforts undertaken in the fall of 1973 or earl
not deemed to be successful in the judgement c
by.June 15, 1974,
The motion for the adoption of the foregoing Resolution` -was
duly seconded by Councilman Seibold and upon vote being
taken thereon, -the following voted in favor thereof:
Councilmen Hunt, Spaeth and Seibold The
following voted against or abstained: None
