Pursuant to due call and notice thereof, a regular meeting
of the Village Council of the Village of Plymouth, Minnesota, was
held on the 16th day of July, 1973. The following members were
present: Maynr Hilde. Councilmen Hunt, Spaeth and Neils
The following members were absent: Councilman Seibold
Councilman Spaeth introduced the following Resolu-
tion and moved its adoption:
RESOLUTION NO. 73-271
A RESOLUTION WAIVING THE REQUIREMENT OF SECTION
462.358, SUBDIVISION 4, MINNESOTA STATUTES AND
SECTION 9.02 OF CHAPTER VII OF THE VILLAGE CODE
RELATIVE TO CONVEYANCES BY METES AND BOUNDS OF
PARCELS OF LAND CONTAINING LESS THAN FIVE ACRES
WHEREAS, Albert C. Nelson, who owns land in Section 4 of the Village of
Plymouth, has requested a Subdivision Variance, and
WHEREAS, the Village Planning Commission has reviewed said request and
recommends approval, and
WHEREAS, the Village Council has now determined that the subdivision of
said land into two parcels, one of which would contain less than five (5)
acres, would not interfere with the purposes of the Subdivision Regulations
of the Village of Plymouth and that a refusal to permit such subdivision
would create an unnecessary hardship on such owner,
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE VILLAGE COUNCIL OF THE
VILLAGE OF PLYMOUTH as follows:
1. Compliance with the provisions of Section 462.358, Subdivision 4,
Minnesota Statutes, and Section 9.02 of Chapter VII of the Village
Code relating to conveyances by metes and bounds of parcels of
land containing an area of less -than five (5) acres is hereby
waived with respect to'the following described parcels:
PARCEL A
East 324 feet of that part of the North 1747 23/100 feet
of the West one-half of the Northeast one-quarter lying
South of center line of -County Road 47 except roads. All
in Section 4, Township -118, Range 22.
PARCEL B
Beginning at a point on the West line of the West one-half
of the Northeast one-quarter distance 330.45 feet North of
the Southwest corner thereof, thence North along said West
line 330.45 feet; thence East 341 feet; thence South 34.5
feet; thence East 375 feet; thence North 34.5 feet; thence
East to a point distance 324 feet West from the East line
of the West one-half of the Northeast one-quarter; thence
North to intersection with a line running West at right
angles from a point in East lire thereof distance 1747
23/100 feet South from the Northeast corner of the West
one-half of the Northeast one-quarter; thence East 324
feet to East line thereof, thence South to a point distance
330.45 feet North of the Southeast corner of the West one-
half of the No-theast one-quarter; thence West to the
beginning, except roads. All in Section 4, T6iship 118,
Range 22.

2. The Village Clerk is directed to prepare a certified copy of this
Resolution for recording purposes.
The motion for the adoption of the foregoing Resolution was
duly seconded by Councilman Neils , and upon vote being
taken thereon, the following voted in'favor thereof: Mayor
Hilde, Councilmen Hunt, Spaeth and Neils The
following voted against or abstained: None
Whereupon the Resolution was declared duly passed and adopted.

I, the undersigned, being the duly qualified and acting Clerk of the
Village of Plymouth, Minnesota, hereby certify that I have carefully compared
the foregoing extract of the minutes of a regular meeting of the Village Coun-
cil of said Village held on July 16, 1973, with the original thereof on file
in my office, and the same is a full, true and complete transcript therefrom.
