HomeMy WebLinkAboutCity Council Resolution 1973-243VILLAGE OF PLYMOUTH Pursuant to due call and notice thereof, a regular meeting of the Village Council of the Village of Plymouth, Minnesota, was held on the 2nd day of July, 1973. The following members were present: Mayor Hilde, Councilmen Hunt, Spaeth and Neils. The following member was absent: Councilman Seibold. Councilman Neils introduced the following Resolution and moved its adoption: RESOLUTION NO. 73-243 POLICY ADOPTING STANDARDS AND GUIDE LINES FOR DETERMINING THAT PORTION OF LAND BEING PLATTED, SUBDIVIDED OR DEVELOPED WHICH IS TO BE CONVEYED OR DEDICATED TO THE PUBLIC FOR PARK OR PLAYGROUND PURPOSES OR WITH RESPECT TO WHICH CASH IS TO BE CONTRIBUTED TO THE VILLAG2' IN LIEU OF SUCH CON- VEYANCE OR DEDICATION ALL AS PROVIDED BY SECTION 7.06 OF CHAPTER VIT OF THE VILLAGE CODE WHEREAS, the 1973 Legislature of the State of Minnesota did amend the provisions of Section 462.358, Supdivision 2, Minnesota Statutes, and WHEREAS, said amendment did significantly modify the provisions of said statute relating to conveyance or dedication of lands to public use for parks, playgrounds, public open space and storm water storage in connection with the subdividing and development of lands for residential, commercial and indus- trial uses, and WHEREAS, the Village Council did on the 2nd day of July, 1973 adopt Ordinance No. 73-12 (codified as Section 7.06, Chapter VII of the Village Code) relating to such conveyance and dedication of such lands, and WHEREAS, Paragraph 3 of said Ordinance provides that the Village Manager shall develop and recommend to the Council standards and guide lines for de- termining that portion of each development and subdivision which should reason- ably be required to be conveyed or dedicated to the Village for park, play- ground, public open space and storm water holding areas, and WHEREAS, the Village Manager has made such recommendations and the Village Council desires that they should be adopted, NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE VILLAGE COUNCIL OF THE VILLAGE OF PLYMOUTH AS FOLLOWS: 1. The Village Council recognizes that it is essential to the health, safety and welfare of the residents of the Village of Plymouth that the character and quality of the environment be considered to be of major importance in the planning and development of the Village. In this regard the manner in which land is developed and used is a matter of high priority. The preservation of land for park, play- ground, public open space and storm water holding purposes as it relates to the use and development of land for residential, com- mercial and industrial purposes is essential to the maintaining of a healt'ful and desirable environment for all of the citizens of the Village. We must not only provide these amenities for our citizens today, we must also be mindful of our future citizens. It is recognized by the Village Council that the demand for park; playground, public open space and storm water holding areas within a municipality is directly related to the density and intensity of development permitted and allowed within any given area. Urban type developments mean greater numbers of people andtihigher demands for public recreational facilities and storm water holding areas. To disregard this principle is to inevitably over -tax existing facilitie and thus diminish the quality of the encironment for all. It is therefore determined to be the public policy of the Village of Plymouth that the following standards and guide lines for the dedi- cation of land for.park, playground; public open space and storm water holding purposes (or cash contributions in lieu of such dedi- cation) in the subdividing and developing of land within the Village shall be directly related to the density and intensity of each resi- dential, commercial and industrial subdivision and development. 2. Subdividers and developers of residential land within the Village of Plymouth shall be required to dedicate to the Village of Plymouth for park, playground, public open space and storm water holding_ purposes that amount of land equal to the value of than percentage of land within the development as set out below: 3. 4. "DWELLING UNITS PER ACRE 2 3-4 5-6 7-8 9-10 11-12 13-14 15-16 LAND VALUE TO BE DEDICATED For each unit above 16 add .5% 10% 12% 14% 16% 18% 20% 21% 22% Subdividers and developers of commercial and industrial Land within the Village of Plymouth shall be required to dedicate to the Village of Plymouth for park, playground, public open space and storm water holding purposes that amount of land having a value equal to ten (10) percent of the land value within the development. In those cases where subdividers anddevelopersof land within the Village of Plymouth provide amenities, such as, but not limited to, swimming pools, tennis courts, handball courts, ballfields, etc., within the development for the benefit of those residing or working therein, and where, in the judgment of the Village Manager, such amenities significantly reduce the demands for public recreational facilities to serve the development, then, and in that case, he may recommend to the Village Council that the amount of land to be dedi- cated for park, playground, public open space and stormwater hold- ing purposes (or cash contributions in lieu of such dedication) be reduced by an amount not to exceed twenty-five (25) percent of the amount calculated above. 5. In those cases where it is determined that a cash contribution shall be made in lieu of land dedication, it shall be understood tha-L, cash contributions shall not exceed a maximum of $150 per dwelling unit for residential or $500 per acre for land being subdivided or le veloped for commercial or industrial purposes to meet the require- ments of this policy. 6. This resolution is to be construed as a part of and administered in conjunction with Section 7.06, Chapter VII of the Village Code. The motion for the adoption of, the foregoing Resolution was duly seconded by Councilman Hunt, and upon vote being taken there- on, the following voted in favor thereof: Mayor Hilde, councilmen
