HomeMy WebLinkAboutCity Council Resolution 1973-217VILLAGE OF PLYMOUTH Pursuant to due call and notice thereof, a regular meeti j of the Village Council of the Village of Plymouth, Minnesota, was held on the 18th day of June, 1973. The following members were present Mayor Hilde, Councilmen Hunt. Spaeth, Seibold and Neils. The following members were absent: None Councilman Seibold introduced the following Resolution and moved its adoption: RESOLUTION NO. 73-217 WHEREAS, Bruce Hubbard, representing the owners of land at 1015 North County Road 18, has requested a subdivision variance, and WHEREAS, the Village Planning Commission has reviewed said request, and WHEREAS. the Village Council has now determined that the subdivision of said land into two parcels, each of which would contain less than five (5) acres, would not interfere with the purposes of the Subdivision Regulations of the Village of Plymouth and that a refusal to permit such subdivision would create an unnecessary hardship on such owners, NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE VILLAGE COUNCIL OF THE VILLAGE OF PLYMOUTH as follows: 1. Compliance with the provisions of Section 462.358, Subdivision 4, Minnesota Statutes, and Section 9.02 of Chapter VII of the Village Code relating to conveyances by metes and bounds of parcels of land containing an area of less than five (5) acres is hereby waived with respect to the following described parcel: That part of the North 310 feet of the South 540 feet of - the Northeast Quarter of the Northeast Quarter of Section 36, Township 118 North, Range 22 West, -of the Fifth Princi- pal Meridian, lying Northeasterly of a line parallel with and distant 9 feet Southwesterly, measured radially, from the center line of the spur track of the Minneapolis Indus- trial Railway Company, as said -spur track is now located, and tying Westerly 'of the Westerly line of a tract of land described in that certain Quit Claim Deed dated September 9, 1968. between the Minneapolis:Industrial Railway Company and the County of Hennepin. Also, That part of the West 100 feet of the East 625 feet of the South -230 feet of said Northeast Quarter'of the Northeast Quarter of Section 36 lying Northeasterly of a line parallel with and distant 9 feet Southwesterly, measured radially. from siid spur track center line. 2. The Village Clerk is directed to prepare a certified copy of this Resolution for recording purposes. The motion for the adoption of the foregoing Resolution was duly seconded by Councilman Spaeth , and upon vote being taken thereon, the following voted in favor thereof: Mayor Hilde, Councilmen Hunt, Spaeth, Seibold and Neils The following voted against or abstained: None Whereupon the Resolution was declared duly Edssed and adopted.
