HomeMy WebLinkAboutCity Council Resolution 1973-192VILLAGE OF PLYMOUTH Pursuant to due call and notice thereof, a regular meeting of the Village Council of the Village of Plymouth, Minnesota, was held on the 21st day of May, 1973. The following members were present: Mayor Hilde, Councilmen Hunt, Spaeth and Neils The following members were absent: Councilman Seibold Councilman Spaeth introduced the following Resolu- tion and moved its adoption: RESOLUTION NO. 73-192 WHEREAS, Dreyfus Interstate Development Corporation, as developers of the Amber Woods plat ir, the Village of Plymouth have executed a development contract in which they have agreed to accept water and sanitary sewer area assessments in the amount of $64,350.00, and WHEREAS, Dreyfus Interstate Development Corporation has submitted a written waiver of assessment hearing with respect to these assessments on Plat 43719, Parcel 5520, which parcel represents the land being platted, NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE VILLAGE COUNCIL OF THE VILLAGE OF PLYMOUTH that water area assessments for 143 lots i f225 per lot totalling $32,175 and sewer area assessments for 143 lots 0 $225 per lot totalling $32,175 represents area assessments due the Village under the terms of Section 8.3 of the development contract between the Village and Dreyfus Interstate Development Corporation, and BE IT FURTHER RESOLVED that the aforementioned assessments are affiro ed, adopted and confirmed, and BE IT FURTHER RESOLVED that said assessments shall be certified to by the Village Clerk and filed in her office and shall thereupon be and constitute the special ,ssessment for Amber Woods water and sanitary sewer area charges, and BE IT FURTHER RESOLVED that the amounts assessed against the subject parcel of land shall bear interest from March 19, 1973 in accordance with the 1 - terms of the development contract until the same have been paid at the rate of 8% per annum and FURTHER that such assessments shall be payable in five (5) equal annual installments payable on the first day of January each year begin- ning the year 1974 and shall continue until all said installsients shall have been paid, each installment to be collected with taxes collectible during the same year by the County Auditor, and to the first instailment shall be added interest on the entire assessment from March 19, 1973 to December 31, 1974. To each subsequent installment shalt be added interest for one (1) year upon all unpaid installments and FURTHER that the Village Clerk is hereby directed to make up and file in the office of the County Auditor of Hennepin County a certified statement of the amount of all such unpaid assessments and the amount which will be due thereon on the first day of January each year. The motion for the adoption of the foregoing Resolution was duly seconded by Councilman Neils , and upon vote being `taken thereon, the following voted in favor thereof: Mayor Hilde. j Councilmen Spaeth and Neils _ _ The ,following voted against or abstained: Councilman Hunt i ;Whereupon the Resolution was declared duly passed and adopted.
