HomeMy WebLinkAboutCity Council Resolution 1973-103VILLAGE OF PLYMOUTH Pursuant to due call and notice thereof, a regular meeting of the Village Council of the Village of Plymouth, Minnesota, was held on the 5th day: of March, 1973. The following members were present: Mayor Hilde. Councilman Hunt, Spaeth and Neils The following members were absent: Councilman Seibold Councilman Neils introduced the following Reso- lution and moved its zdoption: RESOLUTION NO. 73-103 WHEREAS, for the public safety and welfare, it is necessary to protect and preserve the public'sinvestment in the streets and roads of the Village of Plymouth from premature deterioration and break-up occasioned by the alternate thawing and freezing cycle experienced in the late winter and early spring, and WHEREAS, in order to minimize the aforementioned damage to our streets and roads, and pursuant to the authority contained in Section 169.87, the Village posts load limits on certain of its streets and roads, and WHEREAS, in order to facilitate the movement of goods and materials, particularly those destined to construction sites, it maybe necessary to permit overweight vehicles on certain streets and roads, NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE VILLAGE COUNCIL OF THE VILLAGE OF PLYMOUTH that it is the policy of the Village of Plymouth that load limits shall be established at such times and on such streets and roads throughout the Village of Plymouth as shall be determined by the Village Engineer, and BE IT FURTHER' RESOLVED that in the event private parties desire to exceed these load limits, they shall obtain a permit from the Village En- gineer, and they shall be required to submit to the `Village cash or a cer- tified check in an amount to be determined by the Village Engineer, such amount to be based upon the anticipated potential damage which could be occasioned.by such hauling, and BE IT FURTHER RESOLVED that the Village Engineer shall be authorized to revoke any such overweight permits when, in his judgment, substantial damage is being Caused to the street or road, and BE IT FURTHER RESOLVED.that the Village Engineer shall be authorized to deduct from said cash deposit any sums necessary to restore the street to its design standards:ln the event of damage, following the expiration or revocation of an overload permit, or the lifting of load limits, and BE IT FURTHER RESOLVED that it shall be the policy of the Village of Plymouth to presume that any damage occurring on any street ov road over which vehicles have permission to travel overweight, shall have been caused by said vehicles. The motion for the adoption =)f the foregoing Resolution was duly seconded by Councilman 'Spaeth , and upon vote being taken thereon, the following voted in favor thereof: Mayor Hilder Councilmen Hunt, Spaeth and Neils The following votedagainstor abstained: None Whereupon the Resolution was declared duly passed and adopted.
