Pursuant to due call and notice thereof, a special meeting
of the Village Council of the Village of Plymouth, Minnesota, was
held on the 26th day of February, 1973. The following members
were present: Mayor Hilde, Councilmen Spaeth and Neils
The following members were absent: Councilmen Hunt and Seibold
Councilman Spaeth introduced the following Res-
olution and moved its adoption:
RESOLUTION NO. 73-95
WHEREAS, the Minnesota House of Representatives is presently actively
considering House File 295, a bill to amend the Public Employees Labor Rela-
tions Act, and
WHEREAS, the bill in its present form is deemed to be a radical depar-
ture from recognized and effective labor relations legislation, and
WHEREAS, the bill in its present form if enacted, would cause less
effective and meaningful collective bargaining, as well as encourage the
deterioration of harmonious relations for most communities, and
WHEREAS, the bill in its present form would tend to place public em-
ployees in a completely different class from all other segments of the labor
ing community by providing them special considerations not contained in
traditional labor management legislation,
NOW, THEREFORE,'BE IT HEREBY RESOLVED BY THE VILLAGE COUNCIL OF THE
VILLAGE OF PLYMOUTH that this Council opposes the adoption of House File
295 in its present form, and
BE IT FURTHER RESOLVED that the House and Senate be encouraged to amend
House File 295 to clearly indicate the following;
1. That the term and definition of "supervisor" be consistent with
that of the National Labor Relations Act;
2. That secondary boycotts of any type be explicitly forbidden;
3. That agency shop provisions not be authorized;
4. That the scope of management's rights not be diluted;
5. That the primary role of the locally elected public official to
determine -local priorities and programs not be a subject for col-
lective bargaining;
6. That recognition provisions for collective bargaining units remain
unchanged;
7. That any provision which would restrict the authority of district
or other courts to issue temporary or permanent restraining orders
or injunctions and/or to assess other penalties under the act be
stricken.
BE IT FURTHER RESOLVED that this Council recognize: that effective
labor management relations in the public sector is essential frr the delivery
of effective and efficient public services, and that House File 295, if adopt-
ed in its present form, would seriously weaken the significant progress made
in this area during the past years.

The motion for the adoption of the foregoing Resolution was
duly seconded by Councilman Neils , and upon vote being
taken thereon, the following voted in favor thereof: Mayor
Hilde. Councilmen Spaeth and Neils The
following voted against or abstained: None
Whereupon the Resolution was duly passed and adopted.

1, the undersigned, being the duly qualified and acting Clerk of the
Village of Plymouth, Minnesota, hereby certify that I have carefully compared
the foregoing extract of the minutes of a special meeting of the Village
Council of said Village held on February 26, 1973, with the ortiginal thereof
on file in my office, and the same is a full, true and complete transcript
therefrom.
