i Pursuant to due call and notice thereof, a special meeting

;;held on the 20th day of February. 1973. The following members

Councilman Spaeth introduced the following Resolu
tion and moved its adoption:
RESOLUTION NO. 73-73
WHEREAS, during the construction of certain public improvement projects.
it becomes necessary, due to unforeseen circumstances, to construct utility
services onto private property, and
WHEREAS, it is the policy of the Village of Plymouth not to normally
extend public improvement projects onto private property,
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE VILLAGE COUNCIL OF THE
VILLAGE OF PLYMOUTH that it shall be the policy of the Village not to extend
utility services onto private property at Village expense. Provided, however,,
that in the following circumstances such services may be so extended with the
approval of the Village Engineer:
1. When access to a property is by way of a private easement or
over a tract of land in a Registered Land Survey reserved for
such purpose. In such event, the Village Engineer will obtain
from all affected property owners without cost to the Village,
the requisite and necessary permission to use such easement or
tract for the installation and maintenance of the utility ser-
vices. Such permission shall include the right of the Village
to levy special assessments for the cost of such installation
as though such instal'ition was placed in a public thoroughfare.
2. When it is deemed by the Village Engineer to be in the best
j interests of the Village in terms of insuring a quality -like
project and/or to protect the Village's utility system from
damage. In such event the Village Engineer may authorize the
extension of such services to a reasonable point beyond the
property line provided that,
(a) the property owner involved is advised of such exten-
sion and agrees to incur the total expenses thereof,
and,
j (b) immediately upon completion of such extension the cost
thereof shall be bilked to the property owner and not
levied as a special assessment.
The motion for the adoption of the foregoing Resolution was
duly seconded by Councilman Seibold , and upon vote being
taken thereon, the following voted in favor thereof: Mayor
Hilde, Councilmen Hunt, Spaeth, Seibold and Neils The

following voted against or abstained: None
Whereupon the Resolution was declared duly passed and adopted.

Village of Plymouth. Minnesota, hereby certify that I have carefully compared

file in my office, and the same is a full. true.and complete transcript there-
from.
