HomeMy WebLinkAboutCity Council Resolution 1973-048VILLAGE OF PLYMOUTH Pursuant to due call and notice thereof, a regular meeting of the Village Council of the Village of Plymouth, Minnesota, was held on the 5th day of February, 1973. The following members were present: Mayor Hilde, Councilmen Hunt, Seibold and Neils. The following members were absent: Councilman Spaeth. Councilman Hunt introduced the following Resolution and moved its adoption: RESOLUTION NO. 73-48 A RESOLUTION WAIVING THE REQUIREMENT OF SECTION 462.358 SUBDIVISION 4, MINNESOTA STATUTES AND SECTION 9.02 OF CHAPTER VII OF THE VILLAGE CODE RELATIVE TO CONVEYANCES BY METES AND BOUNDS OF PARCELS OF LAND CONTAINING LESS THAN FIVE ACRES WHEREAS, Ronald L. Libby, who owns land in Section 2 of the Village of Plymouth, has requested a subdivision variance, and WHEREAS, the Village Planning Commission has reviewed said request and. recommends approval, and WHEREAS, the Village Council has now determined that the subdivision' of said land into two parcels, one of which would contain less than five (5) acres, would not interfere with the purposes of the Subdivision Regulations of the Village of Plymouth and that a refusal to permit such subdivision would create an unnecessary hardship on such owner, NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE VILLAGE COUNCIL OF THE VILLAGE OF PLYMOUTH AS FOLLOWS: 1. Compliance with the provisions of Section 462.358, Subdivision 4. Minnesota Statutes, and Section 9.02 of Chapter VII of the Village Code relating to conveyances by metes and bounds of parcels of land containing an area of less than five (5) ares is hereby waived with respect to the following described parcels: PARCEL A The East 186.28 feet of the Northeast 1/4 of the Northwest 1/4 and the East 186.28 feet of Government Lot 4 lying North of the centerline of County Road #10, all in Section 2, Township 118, Range 22, except Road. PARCEL B The East 186.28 feet of Government Lot 4, Section 2, Township 118, Range 22, lying South of the centerline of County Road #10. 2. The Village Clerk is directed to prepare a certified copy of this Resolution for recording purposes. The motion for the adoption of the foregoing Resolution was duly seconded by Councilman Neils , and upon vote being 'i {# taken thereon, the following voted in favor thereof: Mayor Hilde, !i Councilmen Hunt, Seibold and Neils The following voted against or abstained; None Whereupon the Resolution was declared duly passed and adopted.
