The followingmembers were present: _Mayor Hilde, Councilmen Hunt, Spaeth and seibold The following member were absent: Councilman Neils Councilman Seibold introduced the following Res- olution and moved its adoption: RESOLUTION NO. 73-20 WHEREAS, the Village of Plymouth acquired a sanitary sewer and watermain easement from Delmer L. and Margaret J. Weaver on June 30, 1969. for the South- west water and sanitary sewer projects, and WHEREAS, said easement has been discovered to be in error. and WHEREAS, the Village of Plymouth now requires an additional utility ease- ment across, the Weaver's property, NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE VILLAGE COUNCIL OF THE VILLAGE OF PLYMOUTH that the Village accepts from Delmer L. and Nargaret J. Weaver a 40 foot utility easement, as prepared by the Village Attorney, and FURTHER, the Manager is hereby directed and authorized to execute the necessary documents to vacate the former easement of June 30, 1969. The motion for the adoption of the foregoing Resolution was duly seconded by Councilman Spaeth and upon vote being taken thereon, the following voted in favor thereof: Na-vor Hilde, Councilman Hunt. Spaeth and Seibold The following voted against or abstained:_ None Whereupon the Resolution was declared duly passed and adopted. STATE OF MINNESOTA ) COUNTY OF HENNEPIN ) SS.
