HomeMy WebLinkAboutCity Council Resolution 2020-042 C ITY OF P LYMOUTH R ESOLUTION N O. 2020-042 R ESOLUTION A PPROVING THE F IRST A MENDMENT TO E NCROACHMENT A GREEMENT FOR R ETAINING W ALLS AND F ENCES ON P ROPERTY L OCATED AT 5855 C HESHIRE P ARKWAY N ORTH WHEREAS, a letter was received from Melinda Dugas with Stinson LLP on behalf of LCS- Westminster Partnership V LLP, property owner, requesting the City approve the first amendment to encroachment agreement allowing retaining walls and fences to be constructed within drainage and utility easements at 5855 Cheshire Parkway North; and WHEREAS, the amended encroachment agreement permits only the retaining walls and fences within the easements and all related facilities must still meet all applicable City codes; and WHEREAS, the owner’s properties are legally described as: Lot 1 Block 1 Trillium Woods. NOW, THEREFORE BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that the first amendment to encroachment agreement which will allow the retaining walls and fence in the drainage and utility easements at 5855 Cheshire Parkway North, is approved.
