RESOLUTION No. 2009-085
A RESOLUTION TO APPROVE PAYMENT NO. 6 AND FINAL
COUNTY ROAD 47/61 INTERSECTION IMPROVEMENTS
S.P. 155-020-018 AND S.P. 27-661-043
CITY PROJECT NO. 6108
WHEREAS, the City of Plymouth as owner and Knife River Corp., as contractor, have entered into
an agreement for County road 47/61 Intersection Improvements, City Project No. 6108, said
agreement being approved on May 22, 2007; and
WHEREAS, the City Engineer has certified his acceptance of the work and his approval of the final
request for payment.
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE
CITY OF PLYMOUTH, MINNESOTA:
1. That the original contract amount was $838,920.20. One change order was approved
in the amount of $36,004.40 and the total value of the work to date is $941,125.91 and
is herewith approved. This project exceeds the revised contract amount by $66,201.31
or 7%.
2. That the work performed by the contractor for County Road 47/61 Intersection
Improvements and certified to the Council by the City Engineer as acceptable, being
the same, is hereby released from the contract except as to the conditions of the
performance bond, any and all legal rights of the owner, required guarantees and
correction of faulty work after final payment.
3. Request for Payment No. 6 and Final in the amount of $195,838.72 to Knife River
Corp. for County Road 47/61 Intersection Improvements is hereby approved and the
Director of Administrative Services is hereby authorized and directed to pay the same
forthwith.
4. Final funding will be as follows:
Developer $1,142,165
Hennepin County 121,000
Special Assessments 1135
$1,265,000
