HomeMy WebLinkAboutCity Council Resolution 2009-080CITY OF PLYMOUTH RESOLUTION N0. 2009-080 A RESOLUTION APPROVING A SITE PLAN AMENDMENT, CONDITIONAL USE PERMIT, AND VARIANCE FOR PROVIDENT/ WATERFORD, LLC TO ALLOW INSTALLATION OF A DRIVE- THROUGH SERVICE WINDOW AT WATERFORD SHOPPING CENTER, 10200 6T" AVENUE (2009007) WHEREAS, Provident/Waterford, LLC has requested approval of a site plan amendment, conditional use permit, and variance to allow installation of a drive-through service window for the free-standing retail building located in the southwest portion of the site at 10200 6t1' Avenue, for property legally described as Lot 1, Block 1, Waterford Park Plaza, Hennepin County, Minnesota; and WHEREAS, the Planning Commission has reviewed said request at a duly called public hearing and recommends approval. NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Provident/Waterford, LLC for a site plan amendment, conditional use permit, and variance for property located at 10200 6th Avenue, subject to the following conditions: I. The requested site plan amendment, conditional use permit, and variance are hereby approved, in accordance with the plans received by the City on March 26, 2009, except as may be amended by this resolution. 2. The conditional use permit requested to allow an accessory drive -up window is approved, based on the finding that all applicable conditional use standards have been met. 3. The variance requested to allow reduced vehicle stacking for the designated drive- through service lane is approved, based on the finding that all applicable variance standards have been met. 4. The drive-through shall be restricted to use by coffee retailers, and shall not be used for other uses including fast food. 5. The operation shall be responsible for litter control within 300 feet on a daily basis. A trash receptacle must be provided at a convenient location to facilitate litter control. 6. Signage shall comply with the signage regulations and shall receive prior approval of the appropriate sign permit. 7. Prior to issuance of building permits, the applicant shall submit the required financial guarantee for proposed site improvements. Resolution 2009-080 (2009007) Page 2 8. Prior to issuance of building permits, the following revisions shall be made to the plans: a. Include a stop sign and "left turn only" sign at the exit for the drive-through lane. b. Include City details STRT-1 for curb and gutter and STRT-11 for the cross gutter on the constriction drawings. The cross gutter shall be installed along that portion of the existing driveway exit lane where curb and gutter will be removed to accommodate the drive-through lane. c. Include a directional sign in the parking lot island near the beginning of the stacking lane for the drive-through, as approved by staff 9. The area located directly south of the drive-through pick-up window shall not be used for outdoor dining. 10. Standard Conditions: a. The speaker system shall not be audible from residential property, and shall comply with Section 21105.10 of the Zoning Ordinance. b. The site plan amendment, conditional use permit, and variance shall expire one year after the date of approval, unless the property owner or applicant has substantially started constriction of the project, or unless the landowner or applicant has received prior approval from the City to extend the expiration date for up to one additional year, as regulated under Sections 21045.09, 21015.07, and 21030.06 respectively, of the Zoning Ordinance.
