R ESOLUTION N O. 2019-329
R ESOLUTION A PPROVING R EQUEST FOR P AYMENT N O. 8 AND F INAL
P LYMOUTH C REEK S TREAM R ESTORATION (WRS16007)
WHEREAS, the City of Plymouth as the owner, and Standard Contracting, Inc. as the
contractor, have entered into an agreement for the Plymouth Creek Stream Restoration, said
agreement was approved by the City Council on November 14, 2017; and
WHEREAS, the Engineer has certified his acceptance of the work and his approval of the
final request for payment.
NOW, THEREFORE BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PLYMOUTH, MINNESOTA:
1. That the original contract amount was $399,053.65 and that the value of the work
to date is $413,492.13 and is approved. The final contract amount is $14,438.48
(or 3.5%) above the original contract amount.
2. That the work performed by the contractor for the Plymouth Creek Stream
Restoration and certified to the Council by the engineer as acceptable, being the
same, is released from the contract except as to the conditions of the
performance bond, any and all legal rights of the owner, required guarantees and
correction of faulty work after final payment.
3. Request for Payment No. 8 and Final in the amount of $18,254.80 to Standard
Contracting, Inc. for the Plymouth Creek Stream Restoration is approved and the
Finance Manager is hereby authorized and directed to pay the same forthwith.
BE IT FURTHER RESOLVED, that the total project costs shall include construction
of the improvements in the amount of $413,492.24, and engineering and administration
in the amount of $113,574.50 for a total project cost of $527,066.74.
BE IT FURTHER RESOLVED, that funding for this project will be from the Water
Resources Fund in the amount of $527,066.74. The City will be refunded from the
Bassett Creek Watershed Management Commission (BCWMC) for $527,066.74.
APPROVED by the City Council on this 10th day of December, 2019.
